SALEM, Ore., Jul7 7. By an
opinion of the Supreme Court to
day, written by Justice Coshow
modifying the decree of Judge H.
H. Belt in the lower court for
Multnomah county in the case of
the heirs of the late Henry
Wemme, against the appellant
Christian Science Churches of
Portland and the Henry Wemme
endowment fund and the new
trustees of th-e fund. Judge Guy
C. Horliss, who defended the fund
in the original litigation, is allow
ed the full fee of $25,000 claim
ed by him from .the fund. This
gives him $7500 in addition to
$17,500 paid him by the original
trustees of the fund.
This Is modification of th Belt
decree In the lower court, which
had to do with attorneys fees and
which denied a further allowance
to Corliss from the fund and held
that he must look to the churches
for it. Belt held that the original
opinion of the supreme court In
the litigation prevented him from
allowing it from the fund.
The Coshow opinion affirms the
Belt decree In refusing to allow
the new trustees to repudiate the
sale of the so-called "Clackamas
property" to the Salvation Army.
"The cross-appellants (which
Includes the new trustees) seek
to ignore the sale to the Salva
tion Army", says the opinion,
"and treat the White Shield home
In Portland as though it was still
the property of the Henry Wem
me endowment and the Clackamas
property as belonging to the six
churches.
"The Snlvatlon -rmy Is not a
party of this litigation. The court
cannot divest the title of the Sal
vation Army to the White Shield
home without giving it an oppor
tunity to be heard. The Salva
tion Army is an indispensable
party to any litigation which
would divest it of the title It now
