in the appeal of the lAne and Mar
Inn county courts from the Von
Winkle ballot title to the circuit
court.
The two county courts averred
that the ballot titlo ns prepared by
Van Winkle stated that the act lev
ies taxes on buses, whereas, ac
cording to their petition. "It Im
poses charges." The McMahn or
der makes it read, "levy license

taxes.'
Another contention of the coun
ty courts was that the Van Winkle
title did not show- that the act ap
plies only to common carriers. The
order of Judge McMuhuu brings
this out more clearly. i
The bus bill passed by the re-
cent leinlaluru is being refer- j
endumed by the bus lines and It 1
was the ballot title to the refer-
