goods or are to be seized for any
other crime, and that in this In

It is further contended by the de
fense that a properly executed
search warrant must set out with
reasonable exactness the property
or Koods for which the search war
rant Is Issued, while In this case it
alleged only furniture and house
hold goods belonging to J. C. Wains
ley. Prior to the trial of the case the
defense moved to suppress the evi
dence, on the grounds of an illegal
search, but the motion was oerrul
ed by Judge Hamilton. During the
trial of the case the defense ob
jected to the introduction of the
evidence and testimony based upon
the search, but was again overrul
ed. 'After the state's testimony was
In the defense examined two wit
nesses to bring Out the facts of the
search warrant, and then moved for
a directed verdict. Further exami
nation of witnesses was waived,
and the defense made no argument.
! The case went to the jury upon
the state's evidence and a verdict
of guilty was returned.
i Attorney Albert Abraham, repre
senting Mr. Harris, asked time In
which to prepare a motion for a
new trial, and was given until FrM
day to do so. Sentence w ill be pas
sed at that time, ami the defense
attorneys, Mr. Abraham and Elbert
Hermann, state that they expect to
nost bonds at that time for an ap
peal to the supreme court to deter
mine the validity of the warrant up
on w hich the search was made.
The court today worked on the
rase of K. W. Kucnzli against Sam
Director. This case resulted front
an automobile accident last July.
The cars driven by the two prin
cipals in the ufTlon collided near
Oakland, with considerable damage
to both. Kach driver declared him
self to bo right and the other to be
wrong. Mr. Kueiizll filed suit
against Mr. Director for :119.40 to
ipay for the damages to his car, and
Mr. Director immediately orougnt a
