Oregon, enjoining enforcement or
the compulsory education luw. The
litigation Is the first test to reach
the supreme court on the rll!ht of
states to require the education of
children In public schools.
The law was adopted by vote of
the people November, 1922, wus at
tacked as uncnnsitutlonul by the
Society of the Sisters of the Holy
Names of Jesus and Mary and by
the Hill Military Academy. It pro
posed that children between the '
ages of H and lt must attend pub-'
lie schools und prohibited their in

its appeal are that the fourteenth .
amendment to the constitution 4ies

enact laws necessary to promote
the health, safety, peace, morals,
