Suggests Mooney
Be Turned Loose
SAN FRANCISCO, Nov. 17. Dis
trict Attorney Matthew Brady of San
Francisco declared today that if the
court, .hould order a new trial for
Thomas Mooney, now serving life In
the itate penitentiary as a result of
the preparedness parade bomb explo
sion here In 1916, he probably would
mote that the case be dismissed and
Mooney be freed.
Brady made the statement In an
iwr to a letter he received earlier
in the day from Mooney, appealing
lor a new trial.
The district attorney declared he
did not believe Mooney bad received
1 (air trial and that he had been con
victed on evidence which was Ques
tionable. Discussing his reasons for
a probable decision to dismiss the
cue, Brady declared that In a new
trial be would not be able to use
Frank C. Oxman, "Oregon cattle
man," who was the star witness
atalnBt Mooney, because of tho al
iased doubts cast on Oxman's testi
mony. Oxman already has been tried
once for perjury in connection with
lot case.
Brady declared he could not use
Detective Draper Hand as a witness
because of Hand's alleged statement
lo Mayor Rolph In which Hand Is
aid to have declared that he aided
is "framing" evidence against
Mooney.
The other Important witnesses
arainst Mooney were women. Brady
aaid he would not use them because
aa doubted the accuracy of t heir
taitlmony.
Under such circumstances, Brady
said, there would be no material wit
left to testify for the prosecu
tion. Brady added In his statement that.
with Mooney convicted and now serv
iiil his term and with the supreme
court decisions on record sustaining
kla conviction, he himself couid do
nottilng and that It was up to Gov.
ruor oiepnens to initiate any ac
tion which might be taken. Stephens,
those close to him say, is not in
clined to reopen the case.

IN USE FIFTY YEARS

the University of Chicago, reports.
Dr. Breasted, who Is professor of
Egyptology anad oriental history
there, has recently returned from a
survey of most of the important
buried cities of the Near Orient.
The collapse of the Ottoman Em

civilization to unrestricted investiga

fore us an opportunity unprecedented
In the history of humanistic re

The great centers of human life
in the ancient world, the mighty
cities and capitals of Babylonia, As
syria, Persia, Palestine, Syria. Asia
Minor and Egypt, the region where
the earliest civilized societies arose
out of savagery and barbarism to
bring civilization to barbarian Eu
rope all these treasures of human
records which are rapidly perishing
in the whole region about the east
ern end of the Mediterranean lie
there silently awaiting the spade of
the excavator."
It will be possible to clear up the
leading ancient buried cities of west
ern Asia within tho next 25 or 30
years or perhaps a generation, given
sufficient funds and adequate per
sonnel, according to Dr. Breasted.
The task rests with American orient
alists, he said, because no other
counry has the available resources.

THEY ALL WERE AMERICANS
Interesting Observation, en the Prod
uct of the Melting Pot by
Frederick Palmar.
Where were the foreigners? 1 won
dered as I looked at the faces In tbe
street, upon my return from Europe.
The French, who had heard much of
our polyglotry, asked thl. question
when they saw our soldiers march
ing along the roads of France. In
French eyes the men were all of the
type American. Yet they Included for
eign born, as well a. ron. of every
race In Europe, Frederick i'aluier
writes In Harper's.
Are you Americana? their adopted
country asked of them In those trying
days. They gave their answer tn sac-
Iflce at home and In battle, often
ngntlng against an enemy of their own
blood. Zallnskls, Elnstelns, Schmidts,
Bertellls. Katsanjans won the Distin
guished Service Cross, thrilling our
pride with a new sense of nationalism.
Had they now reverted to loyalty to
the lands of their origin? If so, what
had wrought tbe change In their
hearts?
To my fresh view all the people
were distinctively Americans In garb
and taste; In their complexion, which
our clluiate so promptly affect.; to
their brusque and frank civility, their
Intensity, their pleasures, and their
restless motion. Later, as I became
settled at home and more discerning.
I might note that this or thnt person
was of Swedish, Italian. Huni.-nrlun
or Slav stock. Then I would see
through the veneer, as I wss told.
But aren't most of us scatn, not a
new Idea who are "off the reserva
tion." of foreign stock? My people
missed the Mnyflower snd came over
m HtUl. I could not discern that the
descendants of the Pilgrims were more
American than I was or than a durk
eyed telephone girl whose futiier was
an Italian Immigrant

from the point of view of desired
standnrds which must over call our
ambition away from rtngnntlon of
"everything is for the best In tho best
