Mr. Stearns said he entered Into the case merely for the purpose of showing an interest in curbing liquor violations in that vicinity. Mr. Henninger took the stand at 3:30 o'clock and testified that he was 20 years of age and was a Jitney driver by occupation. lie said he had known Neas for eight years and re called meeting htm In the Hanna barber shop on the afternoon of April 30. On that occasion Honninger said Neas entered the shop and nodded to him to go tnto the back room. Tbe witness said he obeyed the instruc tions, with the result that Neas drew a partly, filled bottle from his pocket and offered him a drink of whiskey. He said be took a drink, after which Frank Hogan and Fred Hanna were also invited to participate in the stimulant. Near then left the bar ber shop, according to Mr. Honnin ger. and he did not see him again until the next day. Henningr de nied that he had ever sold Neas or any other person liquor since he had been a resident of Oakland. The wit ness also denied that he made fre quent trips to California or that he housed his automobile in the Smith A Allen garage. Attorney Hermann attempted to prove that a conspiracy existed be tween Mr. Neas and other persons to secure a reward offered by a promi nent Oakland woman for the convic tion of the person or persons who had sold liquor 10 her son. The court held that this theory had nothing to do with the case at issue, anad evi dence bearing on that phase of the defendant's contention was declared to be inadmissible. Oilier witnesses called for the de fense were Fred Hanna, Frank Ho gan, Harvey Mahoney, Harry l'ink aton and It. L. Stearns. Th object of calling these witnesses was to im peach Neas, the prosecuting witness, and prove the good reputation or Henninger. The taking of evidence was still in progress at a late hour this after noon, but it is probable that it will reach the jury tonight. ITMIj LOT IS lfcTFI. The llutchi r Iloj RESTAURANTS TO BE IN SPECTED; SOLDIER'S ACT RESURRECTS ORDINANCE On account of the presence of gol dlers here, it is'probitble that every restaurant, eating nuu-, and milK dispensary iu the city will be in spected hy a committee within the next few days. A few days ago one of the mem bers of the sanitary corps Informed Mayor Kice and other officials- that ihe Government regulations required a sanitary report on the places where the soldiers stationed here were sent to eat. The report also covers water supply, milk and other articles that are used by the troops. After examining the city records, it was discovered that an ordinance ists making it compulsory for similar inspections of all eating places by the city. Also the ordinance re quires a physical examination of all employes before they can go to work, none of the provisions of which hne been observed for sev eral years. The v ordinance w as brought to light last etening at the council meeting and .Mayor Rice stated that an inspection would be made by the health and police committee nt om e. LOCAL AND PERSONAL. George Stearns, of Oakland, spent the day in Roseburg looking after business matters. Mr. and Mrs. Charles Italelgh, of Toriland. arrived here last evening to visit with friends. Mrs. W. (i. Wade returned to her home at Drain this afternoon, fot lawing a short visit here. J. A. Walker went to Salem this afternoon, where he will vifit with his parents, Mr. and Mrs. J.' S. If. Walker. Attorney O. P. Coshow went to Sutheilin this afternoon, where he spent several houiH looking after business affairs. Fred Ouggisborg, of I-eona, was admitted to M'Tcy Hospital this morning, where tomorrow he will un dergo an operation. He will be at tended by Drs. Set her & Stewart. Deputy Sheriff It. C. Powell, of Oakland, came over this morning to attend the trial of Lawrence Hemiin ger, which occurred before Justice of the Peace I. li. Kiddle this after noon. Miss F.st her Stearns, of Yoncalla, will leave for her home tomorrow 'af ter being a patient at Mercy Hospital for several weeks. She underwent quite a serious operation, with Drs.
