OREGON'S PROPOSED HIGHWAY SYSTEM

ple)', follows:
An act to provide for the con
struction of roads and highways in
the Btate of Oregon; to provide for
the issuance of bonds by the state of
Oregon to raise money to carry out
the purposes of this act; to author
ize the State Highway Commission
to take such action and perform
such duties as may be necessary to
meet the requirements of this act;
to designate and authorize the con
struction of certain hard-surfaced
highways and certain post roads and
certain forest roads, aud to provide
for other post roads and forest
roads; to provide for the letting of
contracts for the construction, pav
ing and maintenance, of roads and
highways; to make the surplus
arising from the fees collected un
der House bill No. 503 of the pres
ent legislative session a fund under
the jurisdiction of the State High
way Commission with which to pay
interest and principal on bonded In
debtedness of the State, contracted
by the state for road purposes, and
other lawful claims incurred by said
Commission, and to provide for
modifying the terms of House bill
Xo. 21, passed by the 29th Legis
lative Asembly of the state of Ore
gon, and to provide for submitting
this act to the people, for the call
ing of a special election therefoi,
and declaring an emergency.
Be it enacted by the people of the
state of Oregon:
Section 1. The State Highway
Commission is hereby authorized,
empowered and directed, during the
next five years, to sell the bonds of
the state of Oregon as hereinafter
provided, In an amount sufficient to
meet the requirements of this act.
Provided, that not more than $1.
(100,008 in bs shall be issued
hereunder during the year 1917. and
that not more than $2,000,000 in
addition to any surplus unissued or
unexpended out of the $1,000,000
authorized for the year 1917. shall
be issued ducing the year 191S.
Sec. 2. The State Highway Coin
mission Is hereby authorized, em
powered and directed to enter into
such contracts, appoint such officials,
and do any other act or thing neces
sary to meet the . requirements of
tills act. - ,
Sec. 3. The Attorney General
shall, under the direction - of the
State Highway Commission, prepare
a form of interest-bearing gold bond
'of the state of Oregon, to be sold In
' order to provide funds for the car
rying out. of the purposes of this act.
Said bonds shall be numbered serial
ly, beginning at No. 1, and shall be
payable In the order of their issu
ance. Said State Highway Commis
sion is hereby authorized, empower
ed and directed to issue bonds of the
rtnte of Oregon for the purpose of
carrying out the provisions of this
act in an amount not exceeding $6,
000, ODD, of which sum at least
$1)1)0, 000 shall be issued in detnonl
nations of $r00 each or less. The
lunula Issued in any year under the
provisions of this act shall be pay
able one-twentieth each" year, com
mencing with tlio sixth year after
the Issuanco thereof. One-half of
the bonds payable each year shall be
payable on the first day of April
and the other half on the first da
of October. Each bond shall bear
upon its lace a statement showing
the date of its maturity. Said
bonds shall bear interest at the rate
of 4 per cent per annum payable
semi-annually on April 1 and Octo
ber 1. Principal and Interest on said
bonds shall be payable at the office
of (he State Treasurer at Salem, Or.,
and if said State Highway Conimisi-
sion shall so direct, said bonds may
also provide for the payment at
some other place. Said bonds shall
he in a form embodying an absolute
. promise of the State of Oregon to

the value and weight and fineness
of the date of such bond, and shall
be in such denominations as the
State Highway Commission shall
elect. Thev shall be signed by the
(lovernor. Secretary of State and
State Treasurer. Said bonds shall
bear coupons evidencing the inter
est to become due thereon for each
installment of such interest, upon
which shall be printed the facsimile
of the signature of said officers.
Said commission may, at its option,
cause a part or all of said bonds to
be payable to the purchaser there,
of and register the name of such
purchaser In the office of the State
Treasurer and provide an appro
priate indorsement upon cacli of
such bonds to the effect that the
same will be paid only to the owner
appearing on the register thereol.
and providing a method for reregis
tering the same as the title may lie
passed, and it may also provide that
a part or all of said bonds shall be
pavable to bearer and not sublet
to registration. Not less than ten
days before the payment of the prin
cipal or interest falls due on any of
the bonds provided for in this act,
the State Highway Commission shall
certify to the Stale Treasurer the
amount necessary to meet the pay
ment thereof. I'pon receipt of such
certificate by the State Treasurer he
shall prepare and verify a claim for
Ihe amount mentioned therein, at
taching thereto said certificate, and
present the same to the Secretary
of State, who shall audit such claim
in like manner ns other claims
against the state are audited, and
pay the same out of any moneys
provided by law for the payment
thereof. The State Treasurer Is au
thorized and directed to make any
such payment of principal or Inter
est on said bonds at sii'h place-,
other than at Salem. Or.. a the

Sec. 4. The State Highway Com
mission shall provide such method
as it may deem necessary for the ad
vertisement of each Issue of said
bonds before the same are sold, and
shall also require such deposit with
bids as may he required, and gener
ally shall conduct the sale and Issu
ance of said bonds under such rules
and regulations not Inconsistent
with this net and shall be adopted
by said Commission.
Sec. 5. Tile money arising from
the sale of each issue of bonds shall
lie deposited in the State Treasury
to t he credit of a special fund,
which shall he used in carrying In
to effect the provisions of tills act.
The Secretary of State is hereby au
thorized and directed to audit all
claims Incurred in carrying out the
provisions of tills net in the same
manner as other claims against the
state are audited, and pay the same
from any moneys provided by law
for the payment thereof upon the
submission of duly verified vouch
ers therefor approved by the Com
mission; provided, that bonds nnd
coupons shall be paid as Is provided
In section :i hereof.
Sec. 0. Tile highways described
In se'tions 0 and 7 of tills act are
hereby determined to be highways
of first importance to the general
public of t he state of Oregon. It is
hereby determined that the follow

the public roads, streets aud high
ways of the State of Oregon; to
regulate and license the persons
who drive the same, to prescribe
! penalties for violation hereof and to
i prohibit the unauthorized possession
or use of a vehicle and to provide a
penalty therefor; to license and
Identify all motor vehicles; to limit
the authority of cities and towns on
like subjects concerned with said
vehicles; to prescribe the duties of
the Secretury of State as to certain
provisions of this act; to provide for
the handling and distribution of the
funds derived from the operation of
this act and to repeal all acts and
parts of acta In conflict herewith,"
emalning after the payment of all
claims incurred In carrying out the
provisions thereof or estimated by
the Secretary of State as necessary
to defray any furthor administrative
expenses for the balance of any li
cense year, shall be transerred on
the first day of April and the first
dny of October In each year by the
Secretary of State to an account to
bo expendod under the Jurisdiction'
of the State Highway Commission
In payment of the Interest and prin
cipal as sanio shall become due up
on bonded indebtedness of the State
of Oregon, contracted for road pur
poses under the provisions of this
art or the provisions of ttie said
House bill No. 21, referred to by
title in section 8 of this act. Any.
remainder of such surplus or unex
pended balance so transferred to tile
Jurisdiction of the State Highway
Commission shall be subject to the
payment of any other lawful claim
or claims Incurred or contracted by
said Commission.
Sec. 111. The Stato Highway Coin-
mission is hereby authorized and
empowerod to enter into contracts
for the purpose of constructing the
roads provided In this act; provided.
however, that all contracts shall he
let according to law and in open and
public session of said Commission;
provided lurther, that if, in the opin
ion of the majority of the members
of said Commission, the lowest bid

roads or parts of roads herein au
thorized to be constructed, shall be
excessive, then and In that event,
said Commission shall have the
right and it is hereby empowered
and authorized to reject all bids and
to construct under Its own direc
tion and supervision, nil of such
roads or any part thereof, and to
tills end to accomplish tills purpose
said Commission is hereby author
ized and empowered to purchase or
lease all necessary machinery, equip
ment, tools and appliances and to
employ all necessary help and labor
and to do all things necessary and
convenient to carry out tho provis
