It appears that the ease ot S. E.
Kroha, who l( under arrest on a
charge of boose selling, Is likely to
have more far-reaching result than
was anticipated. Beside the pre
scription books of the Krobn drug
tore, those of several other drug
tore have been under scrutiny ot
the attorneys In the office ot Justice
Marsters. It baa been reported that
an Important factor In the trial, set
for Dec, 21, la that the prescription
was not dated, and apparently had
been changed from one quart to two
quants ot whisky. It la persistently
rumored tnat similar laxity exists in
numerous prescriptions found on file
In other drugstores. This, If true,
will add decidedly to the interest In
this trial. A report has gained cir
culation that an effort was made to
take the Krobn case before the grand
Jury, where the proceedings would
nave been secret, out a punnc Hear
ing In the Justice Court was de
manded Instead. Regardless of pos
sible exposures, the public would
like to see all such cases openly Investigated.

guilty against William J. Leaton, for

The evidence was entirely circum
stantial. Leaton was alleged to have
lost most of the money playing poker.
Three witnesses, William Warren
and D. A. Curry, barbers, and the
Japanese servant of J. W. Dennett,
the banker, testified that they had
gambled with Leaton. It was tnis
evidence which convicted Leaton.

Loss of tho money was discovered
about October U0, when Leaton was
in a hospital for an operation. Losb
of the money so nreyed upon the
mind of Mayor Charles E. Jordan, of
East Side, that he committed suicide
on the night of October 26 by drown

note accusing Leaton ot taking the
money.

NEW YORK, Dec. IS The United
States Court ot Appeals today de
cided the famous Dan bury Hatters'
case In favor of D. H. Loewe, the
plaintiffs, and against the United
Hatters of North America. The court
affirmed a Judgment In favor ot Mr.
Loewe and against the Hatters' or
ganisation for (352,110.
With Interest and coats, the Judg
ment now amount to 1272,000. At
the first trial, held In 1909, the
plaintiffs obtained a Judgment for
1232,240.
Sustaining the second Judgment.
Judge Cole said It wus no longer
debatable "that the anti-trust act Is
applicable to such combinations as
are alleged In the complaint," and
that the act made no distinction be
tween classes of combinations or In
dlvlduals.
The court held that It had been
clearly established that the plaintiffs!
were engaged In an Interstate busi
ness and that the defendants are
members ot a trades union, and af
filiated with the American Federa
tion of Labor, "one of the objects of
the latter organisation being to as
sist Its members In any 'Justifiable
boycott and with financial help In
the ovent of a strike or lockout."
It was shown at the trial that In
March, 1901, the United Hatters had
resolved to unionise the factory of
the plaintiffs and that Mr. Loewe had
been Informed by the union officials
that the hatters "would resort to the
usual methods." In case their plan
should meet opposition. On July 5,
1902. the plaintiffs employes were
directed to go on strike, and It Is
claimed thnt almost Immediately
boycott was established. The plaintiff
asserts that this measure - conveneu
nroflt of 127.000 In 1901, Into
losses ranging from 17,000, In 1902,
to 13000 in 1904.
Judge Coxe said In conclusion or
his finding:
"No one disputes tho proposition
thnt labor unions aro lawful. . All
must admit thnt they nre not only
lawful, but highly beneficial when
lezallv and fairly conducted, but.
