Tbe contention of the Oovernment that power companies can not secure rights of way across National forests without complying with the rerula tlons of the Secretary of Agriculture has been completely sustained, ac cording to the officers of the forest service, by tba opinion of the Circuit Court of Appeals, filed on November 14, in the case of the United Statu versus tbe Utah Power and Light company. In Its decision the court announces that Congress has assumed complete control of the water-power question so far as the public landa are affect ed, and that a state in tbe exercise of Its sovereign authority can not Inter fere with or transcend this constitu tional power of Congress. Since December IB, 1900, the Utah Power and Light Company bas oper ated Its hydro-electric power works on certain public lands In the state of Utah, now forming a part of tbe cache National forest. Tbe Federal Oovernment sought to enjoin tbe oc cupancy of these lands until the com pany should comply with the provi sions of the Act of May 14, 18H6. This act empowered the Oovernment to permit the use of, or rights of way upon, public lands and National for ests, for tbe purpose of generating, manufacturing, and distributing elec tric energy. The power company, on the other hand, alleged that Its rights were secured snd protected by tbe act of July 26, 1868, now Section 2339 of the Revised Statutes.
