day to bring a test case in the Su
preme Court to find out.
The resolution Btates the election
is only for the purpose of submitting
to the voters any mensures passed by
the Legislature that might be re
ferred by referendum petition. As
the resolution provides that an elec
tion must be held If the referendum
was not Invoked, then under Its re
strictions there would be an election
without anything to vote on.
Hut the Attorney-General points
nut that section 1 of article 4 of the
constitution says: "All elections on
measures referred to the people of
the state shall be had nt the biennial
regular general election, except when
the legislative assembly shall order
a special election."
He lnternrets this to mean thAt alt
measures must be submitted ut the'
special election. Including constitu
tional amendments referred by the
Legislature and initiative mensures.
If there be any.
Tho Attorney-Cenerars suit will be
a mandamus proceeding to compel!
the Secretary of State to put all the
measures on tlte ballot.

Bishop David IL Moore, of Cin
cinnati, has paid the damages of ft
awarded by a jury In the Federal
Court In Kansas City, Kan., to Mrs.
Carrlo K. Cope, of Topeka, who sued
him for $".0,000 for alleged libel, the
bishon's attnrnev announced last
night. A letter written by Bishop
