The board of control of the Supreme
I-odice of the Knights of Pythias
acted wilhln its power when It estab
lished in 1907 a fifth class1 of insur
ance, using money from the fund of
i the fourth class for the purpose, held
'Kdward Daniels, muster of chancery,
In un opinion rendered here today.
The derision was In the rase of Frlis
lleimsoth. representing the policy
holders In the fourth class who asked
the court to grant a mandate forcing
me lodge omciuls to repay more
than I8UU.0U0 from the general fund
to the mortuary fund of the fourth
class and also to maintain a separate
expense account of that division.
Mr. Daniels found that in 1907
when the fifth class of insurance was
organised along old line plans, the
fourth division rates had been found
Insufficient. Ho held that the action
of the board of control was best for
the policy holders In that all fourth
class policy holders not wishing to
enter the fifth division were pro
vided for.
The oplulon ends a six year contro
versy In the ranks of the order.
