way. If some claim that people no
longer attend Divine service, there are
three reasons why they will not.

ho Supreme Court has overruled the
answer of the Capital News Publish
ing Company to the charge of con
tempt, brought because of the news
paper's criticism of the Idaho Su
premo Court's decision, which pre
vented the printing of the names of
Roosevelt Progressive Presidential
electors on the ballots. The publish
ers are held to trial, which it set to
start next Monday.
In its answer tho publishers de
clare the urticles were published be
cause they believed that under the
right of free speech, it was their
privilege.
"There was no Intention to impede
the administration of justice," sayB
the answer, "nor could this have
been accomplished for the reason
that the decision had already been
rendered by the court, nnd for the
further reason that, had the decision
been in favor of the Progressive par
ty, no injustice would have been done
to uny voter. Defendants believe
they had a right to express their
honest criticism and in said belief
(they had a wide precedent by reason
oi me decisions 01 a large nu inner
of the learned courts of the United
States, the precedent of the great
newspapers of tho country and the
comments of the meu highest In the
political history of these United
States."
The answer says that the articles
were written with the solo intention
of arousing the voters of the Progres
sive party to what the decision would
mean in event they did not fully
comprehend its significance, and to
urge the voters to write in the names
of the Progressive electors on the
blanks left, on tho ballots.
It was not a matter primarily of
the rights of any parties litigant, but
was a proceeding which affected the
public as a whole," tho defendant
avers.
