This Is tins opinion filed in the Circuit Court here by J ml go L. T. Harris, of Kugene, and to whvh Judge J. W. Hamilton has subscribed bis concur rence. Judge Harris says: "Although, the (uest:on of the es tablishment of a park commission was submitted to the voters on the day of (lie regular election, neverthe less ft was a special election ns to the ipiest Ion of the park com mis sion." After citing supporting decisions in six analogous cases,, Judge Harris continues: "Where notice of such election is prescribed, the failure to give noiice Invalidates the election so far as the special question submitted is con cerned. "Sections 10 and 13 ami section 10-A of the charter of Koseburg, when construed together, prescribe and contemplate the giving of notice to the voters. "There was no notice given to the voters that the park commission question would be submitted, and hence the proposed measure has not been legally adopted." The sections of the charter re ferred to by Judge Harris provide I bat a special election must be au thorized by the city council by the enactment of an ordinance; that the petition for such election must ante date it by not less than 15 0 days and that it must be advertised for ten days in advance in a local newspaper. Not one of these, requirements was complied with. The election was held on October 7 and the petition requesting it was filed only four days beforehand. This alone Invali dated the vote on the question, pre cluding, as it did, the ten days' ad vertising period and rendering nn ordinance of no legal effect. Judge Harris' decision means that Roseburg will not have to worry about a tax levy for a park for an other year, at least. While it is true that the question of creating a commission can be voted on again by compliance with the charter re quirements, it is doubtful If the council could be induced to call a special election soon because It would incur expense which the city can 111 afford at the present time and for a purpose that is not absolutely necessary. OtlTI'ATlOX TAX ONLY ki:mi::y now available. Increase of city revenue for Rose burg for the coming year now de pends entirely upon an increase of the city license or occupation tux. The time has lapsed in which It 1b possible to call a special city election for raising the tax limit provided by the city charter twenty days' notice being required for such an election, and the levy must be made by Jan uary 1st of each year. While a gen eral tax levy is really the only equit able method of raising city revenues, we nre confronted by a condition Hint makes an increase in that line Impossible for the coming year. Therefore, it seems that a decided in crease of city license taxes must be made in order to meet the actual necessary current expenses, interest on bonds, etc. As The Review has stated In the past, it is ten times easier to tear down than to build up, but the knockers are always busy and they will doubtless use every effort to prevent any material increase in city license taxes. The revenues in the past have hardly been equal to the necessary expenses, and a reduction of $3000 in the revenues for the coming year was decreed at the re cent election. Now the knockers will doubtless use every effort to prevent any increase of license taxes to help to meet that shortage. Vntess some means is devised to meet this loss of revenue, the decorative street lights will necessarily have to be cut off, or the city's credit will soon be Im paired and city warrants will be sold as a heavy discount, if they can be cashed at all. This would be little less than disaster, for the price the city would have to pay for everything would be increased In proportion to the amount of discount demanded by city warrant buyers. It is hoped that some satisfactory method of meeting the conditions may be devised by the city council and citizens at the special meeting to be held Friday night. However, if the city's warrants are forced to a discount during the com ing year, the responsibility therefor will lie wholly with those who have persistenly defamed the city, and im paired Its revenues and credit. Weatherford. of Alhnny. who pre- nted to Governor West nn affidavit showing extenuating circumstances in the case. Taylor was convicted of murder in the first degree for the killing of A. II. Perry In Harney County. Perry, It Is alleged, had been bounding Taylor for weeks, In sulting him on every possible occa sion, showering him with threats nnd making life so miserable that in fin al despernllon Taylor drew n gun and shot Perry through the body. Stand ing directly behind Perry was Hubert Sell founder, a close personal friend of Taylor. Through the irony of fate the bullet, which passed com pletely through Perry's body, struck Settlemeler. Mefore he died Settle- meior made a statement absolving Tavlor from blame and declaring he was justified In shooting Perry. A press dis patch from Washington, l. (.'., says: "The subcommittee on public buildings met today and heard Hep resentativo Hawley's appeal for new buildings aud Bites at Oregon City and Koseburg. He said f 10U.U0O in each case would he about right. The committee did not seem to be im pressed with tho needs of Koseburg. but intimated that, it was likely to recommend $1.UU0 to buy a site at Oregon City. It may possibly allow something also for a building." It Is generally understood that each Congressman shall be allowed lo name one town in his district for which an appropriation will be made for the erection of a Federal building. This to be Included in the general ap propriation bill for the biennial lerm Last spring Senator llourno secured the passage by the Senate of an ap propriation of $lLT,0lMt for a Federal building at Koseburg. The bill then went to the House, nnd through the active efforts of ,1. W. Perkins and other Koseburg citizens a promise was secured from Mr. Havvley thai he would recommend the Uosoburg building for an appropriation of that sum in the next regular appropriation bill. That seems to be about as fur as be ever went in the matter, with t he result shown In the dispatch herein quoted.
