conditions of actual life to which the
law Is applied. The justice between
man and man, between state and Its

legallKtlc justice Is a dead thing.
"I do not believe In adopting the
recall save as a last resort, when It
has become clearly evident that no
other course will achieve the desired
result. hut either the recall will
have to he adopted or else It will
have to be made much easier than It
now is to get rid, not merely of a
bad Judge, but of a judge who, how
ever virtuous, has grown so out of
touch with social needs and facts that
he Is unfit to longer render good
rvlce on the bench.
"We should be cautious about In
terfering In any way with the judge
In deciHlons which he makes In the
ordinary course as between Individ
uals. Hut when a Judge decides a
constitutional question, when he de
cides what the people as a whole can
or cannot do, the people should have
the right to recall that decision If
they think It wrong. We should
uphold the judiciary In all respects,
but It Is both absurd and degrading
to make a fetish of a Judge or of
any one else.

or had even decided In a contrary
enne. When the Supreme Court of
the state declares a given statute
iiiicoiiKtitulloiial, hecauxe in conflict
with the state or National Constitu

revision by the people themselves.
If It Is sustained, well and good. If
not, then the popular verdict is to be
accepted as final; the decision is to
be treated as reversed.

"A typical carte was the decision
rendered but a few months ago by
the Court of Appeals of my own
state, the Slate of New York, declar
ing uncoiiHiitutioual the working
men's compensation act. lu their de
rision the judges admitted the
wrong and suffering caused by the
practices agailiHt which the law was
aimed. They admitted that other
civilized nations had abolished the
wrongs and practices. Hut they took
the ground that the Constitution or
the Cuited States, instead of being
an Instrument to secure Justice, has
Ingeniously been revised absolutely
to prevent Justice. They Insisted
that the clause In the constitution
which forbade the taking or property
without due process of law, forbade
the el fori which had been made in
the law to distribute among all the
partners in an enterprise the effects
of (he Injuries to life or limb of a
wage-earner. No anarchist orator,
raving agalust the Constitution, ever
framed an indictment so Bcvere as
these worthy and well meaning
Judges must be held to have framed
if their reasoning be accepted as
true. In effect their decision was
that we could not remedy these
wrongs unless we amend the Consti
tution (not the constitution of the
slate, but the Constitution ot the
Nation) by saying that property;
rmild be taken without due process
of law. Many of the Judges of that
court 1 know personally and for them
I have profound regard. Kven for
ns flagrant a decision as this I would
not vote for their recall; for I have
no douht the decision was rendered
with their Ideas of duty. Hut most
emphatlenlly I do wish that the peo

the decistou itself, and authoritative
ly to stamp with disapproval what
cannot hut seem to the ordinary

MATURES CURE

The conditions and causes which produce Rheumatism all suggest a
healthful vegetable remedy as the surest and safest cure. The disease is
brought about by the accumulation ol uric acid, an irritating, pain-producing
property in the blood. This causes a weakening and souring oi the circula
tion which then becomes unfit for nourishing the body, while the deposits
ol uric acid in the nerves, muscles, joints and bones produce the pain and
agony of Rheumatism. To treat the trouble with medicines containing pot
ash or other strong minerals, is simplv adding another poison to the already
weak, diseased blood, sapping it of its remaining vitality, and perhaps in
the end making a physical wreck of the sufferer. The one safe and only cure
for Rheumatism is 8. S. S. It is nature's remedv for this disease, made
entirely from healthful vegetable ingredients extracted from the roots, herbs
and barks of the forest and fields. S. 8. S. goes down into the blood and
removes every trace of the cause of Rheumatism, cleanses and trarifica the
circulation, and restores health and comfort to those who are suffering from
tnia painlul disease. There is but one way to be sure yon are not dosing
your system with mineral medicines, and that is to take & S. S. Book on

Eutcene Guard: "The Utah Con
struction Company Is getting along
rapidly on Its clearing above Natron
and will be ready to begin work
with the steam shovels In a very
short time," said 11. P. Ilooy, head of
Hie 8. P. engineers, who returned
from Natron last evening. "The
clearing has been particularly diffi
cult for several reasons. In the first
place timber is exceedingly heavy.
Then there Is no road and they have
been compelled to construct wagon
roads as they proceeded which with
the wet season made the progress
difficult, lu spite of all this, how
ever, things have gone right ahead.
There are 200 men at work clearing
at prosent and more will be put on
as rapidly as camps can be estab
lished. When spring comes and the
weather settles, the progress on grad
ing will be rapid, as the clearing will
be In such condition as to admit of
rapid work on the grading when It
is once begun."
Nothing to Coast Line.
Asked in regard to the alleged
proposed coast line which Portland
dispatches stated that Messrs. Hoey
and Fontaine were surveying to loin
the P. H. & N. line with the Coos
Kay lino, Mr. Hoey laughed and said:
"Keally, I know nothing about that
beyond what I read In the papers.
There la absolutely nothing to it as
far as I know. I had business over
the P. II. ft N. line and went out to
attend to it, but the Idea that 1 was
looking over a proposed extension
