husband does not contest the divorce
suit brought by his wile, he Is privi
leged, under the lawa of Oregon, to
marry bis newest heart'a desire on
the day following the granting of
the decree. And the same prlvlle.

idea that all divorcees must wait r.ix
months before marrying again, is nil
fiction. It Is only where the parly
who is niade defendant oppose, the
di oue and tiles an answer that the
six months' rule applies.
Tlie knockout blow to the fiction
has been delivered by Justice llean.
In a decision handed down In the
Supremo Court. Justice llean was
called on to pass on the validity of
a marriage contracted within six
months of the date of the divorce
decree. The contention waa made
that it was void under the Oregon
statutes. Justice Bean, howevet,
construed the law difTerently. He
ijuoted section 515 of Lord's Oregon
Laws, which forbids remarriage with
in the time for taking an appeal lu
the divorce suit; the time being with
in six months following the entry
of Judgment. However, he point!
out that this provision cannot apply
to divorces taken by default, which
include 90 per cent of nil divorces
granted.
"No appeal Ilea from a Judgment
or decree granted by confession or
want of answer." explains the Judge.
"From this It Is perfectly manifest
that the statute has nothing to do
with the duality of the decree In de
fault cases. As neither party could
appeal, no necessity arises for th.
delay of six months before the de
cree becomes absolute."
The judge held that the marriage
contracted within six innntliR from
the time of the decree, was binding
The result is that a great bugaboo
has been removed from the puthway
of divorcees.
