The mill ot justice resumed lis grind on the local option cases In the Circuit Court this morning, when Gu a Sparks, an employe at the Smokehouse, in this city, was placed on trial on th.e charge of selling real beer. Introduction of evidence was still In progress at 3 o'clock this afternoon. Attorneys Elbert 11. Her mann, of this city, and Robert G. Smith, ot Grants Pass, are Sparks' attorneys. District Attorney Brown Is prosecuting the case In person. Sparks Is one of the nine liquor sellers Indicted at the term of Cir cuit Court several weeks ago. Three of them have already been convicted. They were fined ench by Judge John S. Coke." Judge J. W. Hamil ton Is presiding over Sparks' trial. Some of the jurors on the case served in the trials of the other liquor dealers. Ed. Irwin, among the remaining six Indictees, entered a plea of not guilty Friday evening. His attorneys are F. G. Micelll and It. W. Marsters. Irwin's trial will follow that of Sparks. The other indicted men awaiting trial are Al and Hen North, Joe llartholomay and J. K. Graham. The evidence Introduced by the state against Sparks is the same as that used in the other cases and was gathered In the quiet round-up made on the night of May 4 by Deputies Sam Stunner and Z. L. Davis, assisted by two transients, II. P. Cochran and A. M. Harden, both of whom failed to appear at the trials. Davis testi fied tills afternoon that he bought a bottle of beer of Sparks, paying cents for It. and Starmer swore tlmtia he witnessed the transaction boei is exhibited In evidence. The complaint filed against Hunt:;r by City Attorney Ncuner was In accortl ance with the ordinance, but its failure to set forth negative excep tions as to street obstructions caused Judge Hamilton to decide that a cause of action, as stated, did not obtain, and he accordingly dlsml&sed the suit. This does not settle tho case, how ever. Attorney Neuner today pro cured an order from the city direct ing Hunter to reinoVa the tank ami shed at once, if he falls to comply, the city marshal will he Instructed to tear them out. WASHINGTON, Juno 24. My a vote of six to three, the Senate com mittee on territories today ordered a favorable report on the joint resolu tion approving the constitutions of Arizona and Now Mexico. The reso lution has already passed the House. The measure provides for the adm's sion of both territories, regardless of the outcome of the elections which they aro to hold. As originally framed, the hill pro vides that New Mexico should he. admitted Immediately, on condition that the people shall vote on an amemlment to their constitution, making that Instrument easier ol amendment in the future. Arizona. For I0 years New Mexico has been clamoring at the doom of Cnngrrvs for admission. Arizona has also long contended its right to statehood. The 19118 Democratic platform pledged the Immediate admission of these territories as separate states.'
