Mr. DyBliiger stood by his original assertion, however, and when the city failed to put in the hydrant where he wanted it he begun charg ing rent for housing the curt. A Mr. Smith .residing on Parrott street, bus offered the city a parcel of land for a cart house if the city i.lll build a sldewulk in front of his premises. Chairman Sykea, of the tire committee, opposes acceptance of the offer, because he considers that any place across the railroad track would be a poor locution for the cart. Councilman Houck remurked that Mr. Dyslnger threatened to commence suit against the city If some action was not taken on his bill. "Let him commence whenever ho wants to." was Mlcellt's rejoiner. Regarding the proposed establish ment of a park at the fair grounds. Olcott. the Salem account ant, reported that the financial records of the city for the year 19HI were thoroughly checked up by him und found correct. The recorder was instructed to file a lien on personal property to secure the expenditure of $122 for the build ing of an abutting sidewalk, which was laid by the city last year. It had to be cou slrued strictly within Us meaning, and It did not apply directly to Hunter's cuse. The ordinance re ferred only to nuisances created by "vegetnble" or "animal" matter nnd not to minerals or chemlrnls, such ns Hunter uses In making the npray. It was then Incumbent upon some ag grieved properly owner to file a civil suit under a general Inw relating to nuisances, and this is whut Mr. Dy singer has done. Early in the spring of 1910. resi dents in the neighborhood of the spruv plant made n formal protest: to the council, which mused Mr. Hunter to cenBe operations only tem porarily. His resumption of the niunnruclorv cnused n second re monstrance to he filed with the coun cil Inst fall. This was referred to the health committee. Dr. Geo. E. Houck chairman, und this committee In Its report requested that no li cense be granted to Hunter for oper ating the plant. The report was ac cepted ln the face of Hunter's bluff to take his plant to some other clly. Hunter went right on ninklng spray, however, even enlarging the capacity of the plant.
