Smith, .Minnesota mil lionaire, and the Linn-Lane Timber Company, knowledge of the conspir acy by which the Government allege it waa dufrauded of 3 3 timber claims in Linn uud Lane counties in 1900 The Government yesterday intro duced four lettei'H from Smith to Puter, which the prosecution con tendH to be direct evidence of its contention that Smith was associa ted with Puter and McKinluy from about the time the flrst tilings were made by resldenlH of Albany and Hrownsville; in February, 1900, to the time that Smith acuulrcd the titles through deeds. At the time of Aibmltting . final proofs the Norhern Pacltle contested nil of the "i7 claims, originally tiled upon, nnd compromised by accepting 24 which Puter nud Mckinley caused to be relinquished hy their dummies. The claims relinquished were drawn by lot, this fact being pouted out hy the Government to sustain lis contention that all of the entrymen were under control by Puter. In his connection the Government Introduced a check for $400 signed by Mr. Krlhs and which, it will con tend, was given to Stratford on the day in which the special agent re ported favorably on the land claimr covered by Iho present litigation.
