ber. Sec. 4. That any person who has
made a location or entry under the
preceding section shall have a
preference right to purchase the
timber on any legal subdivision or
subdivisions of the land covered by
hi location entry, at the lop price
bid therefor at a public sale at
which such timber is offered, upon
payment within 30 day from the
date of such public sale of $1.25 per
acre for all lands covered by the
timber nurchAaed by him, and he
shall nay the purchase price of such
Umber tn such installment and at
such times a the Secretary of the
Interior may direct, but no locator
or entryman so purchasing timber
shall sell or cut or remove the same
or any part thereof from any legal
subdivision covered by his purchase
until the whole of the purchase
price of all timber on such legal
subdivision ha been fully paid for;
providing, that the $1.25 per acre
paid by the locator or entryman for
land covered by timber purchased by
him shall be Applied And credited to
him ujwn the last installment due for
for the purchase price of tbe tim
ber; and further provided, that no
patent shall issue to any locator or
entryman for any lands covered by
timber purchased by him until after
he ha fully paid for such timber
and perforated all the acts required
by the law under which hi location
or entry was made.
How lrYKWits Oistributed.
Sec. h. That the proceeds " from
the sale ot all timber disposed of
under thU act shall. aCter paying the
expenses of appraisal and sale, be
distributed a follows, to-wit; One
fourth s-hall be paid to the state or
territory, to be expended under the
direction of the U-cisJature thereof,
for roads and schools in tbe counties
where the timber sold was located
at the time of the sale. The resi
due of said proceed? from the sale
of timber in tbe states and terri
tories u b?ect to the provisions of
the National Irrigation act. shall be
paid into and remain a part of the
reclamation fund, and the residue of
the prvveeds from the sales of tim
ber in states not subect to the pro
Tiaionc of said act shall go Into the
general funds of the treasury.
Sec. i That as soon as any tim
ber sold under this act has been re
moved from the land, such land shall
become subject to entry or disposal
under the general provisions of the
pnhlio land laws of the United
S:aie if it is not at that time
covered by a valid subsisting entry
Section 7 of the bill repeals all of
the timber and stone act, except
sections 4. 5 and . bat provides
that all pending entries made under
tb.at law mar be perfected upon
