Simmons has Hied a petition In the
County Court asking that she be
declared sane and that property de
creed to her husband be returned to
her, alleging (hat her husband and
J. B. Eddy, right of way agent of the
O. R. & N., conspired to have her de
clared Insane. The Interest of the
railroad man was Inspired by a desire
to secure a right of way through her
property, she says. In December,
1905, H. S. Simmons was appointed
guardian for her, and she says her
guardian did not defend her rights
when her huBband brought suit to
Bccure half her property. She says
she Is perfectly competent to look
after her affairs, and she desires the
Insauity cloud lifted.

Booth-Kelly Lumber Company has
begun suit In the Circuit Court here
to restrain the city of Eugene from
diverting the waters of the McKen
zle river for the city's power plant.
The lumber company bases Its cause
for action on the contention that tne
river has been used for logging pur
poses for the past 30 years, and that
the city's canal would divert bo much
water that It will Interfere wltn tne
company's logging operations. The
city's canal is almost completed and
the machinery la on tne way ior an
electric plant. If a permanent in
junction Is secured, it win cause a
loss to the city of $100,000 or more.

Disturbs Travel on Deer Creek Road

Wildly Insane from the effects of
a two weeks' battle with John Barley
corn, W. M. Coouey, a transient, did
a Marathon stunt on the Deer Creek
road, east of Roseburg, this morning,
in an attempt to distance the Devil,
who kept perslBtently at his heels.
"You're my moat, and I'll get you,"
Cooney says he heard the gentleman
with the cloven hoofs remark.
In order to Increase his speed,
Cooney discarded his shoes and socks,
also his hat, but no matter how fast
be hiked the fellow with the trident
was on the Job like a jackrabbit.
When D. W. Hunter, a South Deer
Creek farmer; came along with his
team and wagon, enroute home,
Cooney attempted to grab the bridle
of one of the horses, but Mr. Hunter
quickly reined hlB team to one side
of the road and then drove gut of the
maniac's reach. Cooney then turned
back toward town, and when a youug
man named Hatfield came along on
horseback he tried to leap up be
hind him. After a brief tussle, Hat
field shook the fellow loose aud sped
away.
When Cooney reached a point near
the Odd Fellows' cemetery he was
met by Sheriff Fenton and submitted
auletly, his mania having passed off
almost entirely, wnue warming nis
mud enveloped feet and chilled body
before the stove In Sheriff Fentou's
office, Cooney appeared rational and
fully realized what he hail ex
perienced. - He acknowledged himself
to be a slave to drink and said that
he had an attack of delirium tremens
three years ago In St. Louts, whore
he waB employed 'by the Simmons
Hardware Company. Of late he has
been working on the Government re
clamation project In the Yakima Val
ley, Washington.
Coonoy is apparently not over ao
years of age. He drifted Into town
yesterday and last night slept in a
barn on the Gaddls place. Early
this morning the effects of alcoholism
began telling on hint. He will bo
sent on his way aB soon as ho Is ablo
to travel.
