At a special meeting of the city
council last night, a new ordinance,
relating to the saniation of the city,
was passed and put Into Immediate
effect. The principal feature of the
ordinance is that It gives the council
committee on health and police full
power 'to abate any public nuisance,
using the police, if necessary. Un
der the old law, which the new one
repeals, the committee had no execu
tive power. It had to report any
violation of the law to the council
. before any action could be taken
against the violator, if the council
failed -to meet at a fixed time the
nuisance went on just the same.
Now It's different. Whenever the
health and police committee observes
a menace to public health they can
order the offender to abate It at once.
If the offender ref ses to comply, the
committee can. have him arrested
forthwith, brought before" the city
recorder and fined. This committee
consists of B. W. Strong, J. W. Mul
len and D. P. Fisher. Here Is the
ull text of
W The Ordinance.
"Be It Ordained by the People of
the City of Roseburg:
'Section 1. No person; persons
or corporation Bhall, within the cor
porate limits of the City of Rose
burg erect, or maintain,, or cause to
be erected or maintained therein,
any nuisance, or suffer or permit
the same to remain or to be main
tained on any premises over which
he 0 it has control, either as ten
ant,' uyidlord or agent.
"Section 2. That no person, per
sona or corporation shall permit or
suffer Ao accumulate in or upon nny
yard, lot, place or premises or upon
any Btreet or sidewalk adjacent to or
abutting upon any lot. block, place
or premises owned or occupied by
him or them or its agents, or for
which he or they may be agent or
agents, within the limits of the City
of Roseburg, any stagnant or im
Jrire water, refuse vegetables, decay
or decaying substances, garbage
or filth of any kind, nor suffer such
yard, lot, place or premises to be or
to remain in such a condition as to
cause or create a noisome or offens
ive smell or atmosphere, or thereby ,
to be, become, cause or create a pub
lic nuisance.
Section 3. That no person or per
sons or corporation shall suffer or
permit any privy which belongs or
appertains to any store, house, build
ing or premises of which said per
son or persons or corporation may be
the owner or occupant or agent, to
become in such a condition as to
cause a noisome or offensive smell,
so as to become a nuisance.
"Section 4. Tt shall be unlawful
for any person or persons or corpor
ation to construct or cause to be con
structed or used any privy or cess
pool under the sidewalk in front of
or adjoining any property owned or
occupied by him or them 'or its
agents.
"Section 5. It shall be the duty
of the Marshal and of the Committee
on Health and Police of the Com
mon Council to see that the provi
sions of Sections 1, 2. 3. and 4 of
this ordinance are enforced.
"In case of a violation of any of
said provisions, the chairman of the
committee on health and police shal
cause a writ-ten notice to be served
upon the person, persons or corpora
tion violating said provision or pro
visions, which said notice shall re

with. If said nuisance Is not abated
and removed within twenty-four
hours from the service of such notice
H shall be the duty of the Marshal
and of the Chairman of said Com
mittee on Health and Police to cause

laton of the same, said person, or
. persons shall be fined not less than
Ten, nor more than Fifty Dollars.

"No person shall keep in any yard,
pen. corral, or enclosure, within the
city limits, any beeves, sheep, swine,
or other animals for sale or to he
slaughtered, for a longer period than
three days, under a penalty of not
less than Ten nor more than Twenty
Dollars.
"Section 7. It shall be unlawful i
for any person or persons to expose i
or offer for sale or to sell within i
the City limits any spoiled or tainted !
meat, fish, fruits, or vegetables or j
the flesh of any calf less than four !
weeks old when slaughtered.
"Any person or persons convicted

"Section 8. No person or persons

joining any street, lane, square, or
public place, public road or in any

or refuse beef or meat of nny ani
mals whether salted or otherwise,,

the offal, or garbage or the offensive

"Section 13. The Marshal shall
report to the atd Committee on
Health and Police all cases of nui
sance being created or maintained or
suffered to exist within said City,
and shall strictly prosecute all cases
that may'come to his knowledge. He
shall have the right to enter any
premises where he nmy have reason
to believe such nuisance exists, and
shall give immediate notice to the
occupants, or owner of said premises
where such may be found, to abate
the same."

Creek, Is again In court. This time
she Is charged with unlawful tres
pass. The plaintiff In the case is B.
J. Howland, of the Citizens State
Hank of Myrtle Creek. Justice John
Long presides at the hearing, which
began In his office in Roseburg at 3 j

Lamb,
The complaint charges Mrs. Lamb 1
with ignoring a verbal notice to va
cate a residence owned by the bank, j
Even when the warrant of arrest was i
served on her this morning she re
fused to budge an inch, and Mnrshal
Ambrose, of Myrtle Creek, had to
carry her bodily from the house to a
buggy, which conveyed them to the
depot, where Mrs. Lamb boarded the
train for Roseburg without persua
sion.
The house in question was former
ly owned by Mrs. Lamb's husband.
who lives apart from her. While
unsucceessful divorce prceedlngs
were pending in the circuit court
here, Lamb and his wife had a fistic
battle for the possession of the place.
This cost Lamb about $90 In a fine
and costs. Mrs. Lamb rofused to
move, and her husband, as a last re
sort, sold the property to the bank.

DIES IX PORTLAND.
Melanchton McCoy, a well known
Civil War veteran of Roseburg, died
in the Good Samaritan Hospital in
Portland this morning. August 5,
1909, following an operation for an
internal malady. He was 59 years of
age. The body will be cremated In
Portland. Mr. McCoy was taken
from Roseburg to the hospital last
Mondny. Mrs. McCoy was wkh him
when he passed away.
Besides the widow there survives
Mr. McCoy one son, Albert McCoy, an
electrician, of Seattle, Wash., and
one daughter. Miss Clara McCoy, who
has been employed In the Roseburg
postolllce for several years past. One
sister, Mrs. S. S. Robb.of Oakland.
Calif., formerly of this city. Is also
left to mourn Mr. McCoy's death.
Mr. McCoy was a native of Illinois
and at the outbreak of the Civil War
served in ae Union Army as a sol
dier from that state. During this
period of his life he suffered a sun
stroke that almost destroyed his eye
sight. Hu was a member of Reno
Post No. i!9, G. A. R., or this cily.
and of the Presbyterian church. He
took an active part in politics and
was prominent in the republican
party In this county. He had lived in
Roseburg for the past eighteen years
and was an exemplary citizen, re
spected by all whom knew him.
DIED.
MiLLER At the home of his moth
er. Mrs. George Stancliff, In Rose
burg. Aug. 4, 1909. Lester' Miller,
aged about 17 years.
The boy had been an invalid al
most from birth. Besides his mother,
he is. survived by his step-father,
two full brothers, two half brothers,
one full sister, and one half sister.
The funeral will be held tomorrow,
with services at the grave In Odd
Fellows cemetery.

' Senator Dolllver. one of the repub

was not a fair representation of his
followers and in some quarters
fraud in balloting Is suspected.

ST. PAUL. Minn., Aug. 6. Arter
holding a posse at pay for three
hours, slaying one man and fatally
wounding another, Henry Paul, who
robbed the First National Hunk this
morning, was shot and killed. After
stealing $000 from the bank, Paul
was cornered nt White Bear Lake by
hla pursuers. The bandit was armed
with a rllio and the .posse got within
range of him only with difficulty. One
bullet II red by Paul killed Ed Larseu
and another mortally wounded Wil
liam Biieles. The posse finally di
rected a volley at Paul, killing him.

Police and detectives are searching
for William Haney, alleged to be a
member of a gang which held up a
Canadian Pacific train near Ashcroft,
B. C, last June, and who afterwards
shot and killed Constable Isaac
Decker. The authorities have re
ceived Information that Haney Is hid
ing somewhere In southern Cali

CAPE TOWN, South Africa, Aug.
5. Tho English steamship Maori,
from New Zealand, foundered near
here last night, carrying down all
hut ten on board who were lauded
here In a life boat this morning. Tho
Maori carried many passengers, and
the exact number of dend Is not
known.
Two warships left today to search
for the steamship Waratah, which Is
nine days overdue, with 300 passen
gers. She was en route here from
Durban, and the trip requires only
two days. It Is feared she may have
been tost In Die cyclone which swept
the coast on her second dny nut.
