Rays: About a year ago newspapers
mrougnout tne country printed a de
cision rendered by the United States
Circuit Court of Appeals In favor of
Wur.-en Hrothcm Company jointly
against the Barber Asphalt Paving
Company, and the City of Owosso,
Michigan, this suit having been
brought by Warren Brothers Com
pany as patentees and owners of the
patents entering the bltullthlc pave
ment, In order to test the vulidily
of their patents.
The Iiarber Asphalt Paving Com
pany had Induced the city olllcials of
Owosso to permit them to lay an imi
tation of the bltulllhlc pavement, the
Asphalt Trust offering the protect
the city with any size idemnity bond,
and to lay their paving about one-half
the actual cost of bltullthlc. The
owners of the bltullthlc patent enter
ed a legal protest against the City
of Owosso and the Asphult Trust, in
order to prevent Infringement of their
patents.
Telegraphic reports received In the
city this morning state that the Unit
ed States Supreme Court has again
dunled the petition for a writ of cer
tiorari, applied lur jointly by the at
torneys for the Asphalt Trust and
the city of Owosso, thereby confirm
ing the opinion rendered by the Unit
ed States Circuit Court of Appeals
and finally ending this litigation,
which has been pending In the courts
lor more than .four years, during
which time most of the testimony
was being taken. All of the leading
chemists and best expert witnesses
upon street paving conditions In the
United States as well as dozciiB of
city engineers from all parts of the
United States, were examined as wit
nesses. The printed testimony, rec
ords and briefs In the case amounted
to over two thousand pages.
The decision of tho United States
Court just rendered is one of great
Importance to all municipalities
throughout the country, as it is final,
and will forever end the attempt to
lay imitation bltullthlc pavement.
The decision of the Court of hast
Appeal finally adjudicates both the
fact of the Infringement and the val
idity of the patents.
Tho introduction of bltullthlc pave
ment began in the year 1901, and litis
since beeu laid by paving companies
in cities under a license agreement
from Warren Brothers Company, In
more than one hundred and
seventy cities In the United States
and Canada, to the extent of over
9,000,000 square yards, or more than
300 miles of city streets.

MEADVILLE, Miss., June 15.
Two are dead, two perhaps fatally In
jured and three slightly injured in a
street battle this afternoon caused by
a feud that had been previously
maiked with tragedy. Great excite
ment followed the fray and troops
were rushed here to guard against
possible tiotlng.
Dr. A .M. Newman, clerk of the
chancery court, and Siias 11. Reynolds
were kliled, and Dr. Lennoz Newman
and Heibett Applewh'te are believed
to be filall.t injured.
L. P. Priichird, brother of Cor
nelius Pritchard, whom Dr. Newman
killed several weeks ago, was arrest
ed, charted with complicity in the
tratcdy. The killing by Newman of
Pritchard was the first bloodshed as
the result of a feud which had ex
isted for months, which grew out of
a political campaign. Newman was
acquitted of the Pritchard murder.
Tho light tcday occurred on the same
spot where Pritchard was slain.

Marshlleld Times: It was semi
officially stated today that the Chas.
Nelson Company had closed the deal
for the purchase of the North Bend
Lumber Company and would assume
IKissession soon.
While no timber is included in the
deal, a contract with the Klondyke
Logging Company for about 17,000,
000 feet goes with It and this will
furnish them a supply until other
arrangements can be made.
It is stated that the Nelson Lumber
Company figured on enlarging the
North Rend mill and probably put
ting on a night shift. While the
mill has been cutting only about
50-000 per day, It is stated that this
could he easily increased to 80,000.
Then with a double-shift, the dally,
output would be Increased to 160,
000. The Nelson Compnny, besides the
export business It does, has quite a
string of retail yards in California
and can market all Its own lumber
to a decided advantage.
