C, March 9 The Secretary of the Interior has Just lamed instructions to the general land olllce which removes a difficulty that has been met in connection with entries under the reclamation act. In a circular of the general land of fice issued January 18, 1908, provi sion is made that after tho require ments of the homestead law as to resldenco and cultivation have been compiled with, .the entryman or his heirs may tnnke final proof of com llllance with those requirements, af ter which he will be relieved of the necessity of residing upon the land. The question arose whether, after having made such proof, the entry- man could assign his Interest In the land without forfeiting his right to a patient. It has now been decided thnt pat ent will Issue In the name of the orig inal entryman In the usual manner. after such final proof has been made, and upon proof that at least one-half of tho Irrlgablo area of tho entry as llnal'ly adjusted has been reclaimed, and upon paymont to the proper of ficials of tho government of the charges, fees and commissions which are duo. Tho Standard Oil Interests are ex pected to appeal from tho decision and carry their case to the Supreme court of tho United States. The decision Is considered a great victory for the Waters-Pierce Com pany and Incidentally for the minor ity Interests of that concern, who claim to have been making unavailing clrortR to free this company from con trol by the New Jersey corporation. With this object In viow, they declin ed to approve the proposition made by the Standard Oil company of In diana, that that company be allowed to continue business In the Btate un der a -tlrusteeshlp composed of repre sentatives of the court and tbe company. With the Judgment of ouster made absolute against the Standard Oil company of Indiana and the Republic Oil conipany, these concerns must pow pay their fines of $00,000 each and cease business in the state. When Informed of the court'B ac tion today,. Attorney General Major said: 'The Supremo court's decision simply means that the Waters-Pierce company will not be ousted from the stole at this time. The shooting has creat ed much excitement nud Smith, after being arrested, was hurried to Sun Danco for fear of violence. County Judge Wonacott was today holding a session of the probato court to hear arguments on the petition to remove H. Wollenberg as adminis trator of tbe estates of 8. Marks Co. and 8. Marks and H. Wollenberg. The petition Is filed by five heirs of Zulklnd Krotkl, deceased, who was a brother of S. Marks and the father of Aaher Marks, both deceased also. They are represented by Atty. C. 8. Jackson, of this city, and Hon. E. B. Watson, of Portland. Mr. Wollen berg Is represented by the local law firm of Coshow and Rice. This pro ceeding follows a recent decision of the Oregon Supreme Court upholding the ruling of Judge McBrldo In the Circuit court at Oregon City, setting aside a deed executed by Zulklnd Krotkl, at the Instance of his son, Asher Marks, or Krotkl, as was his name in the land of his nativity, sel ling for $4000 all of his Interest In the estate of S. MarkB & Co., which estate was appraised at $218,000, of which, under the. law, ho was entitled to one-third, or a little over $70, 000, according to the allegations of tho complaint. The petition now before Judge Wonacott alleges that H. Wollonberg, through tho connivance of Asher Marks,; wrongfully appropriated to himself all of $190,000 In mortgages owned Jointly by himself and the late 8. Marks. Already owning one-half Interest in this amount of mortgages, the petition sets forth that Wollen berg Induced Asher Marks, after 8. Marks' death, to assign him the other half in lieu of. $41,000 In claims which the Wollenberg-Marks concern held against the firm or 8. Marks & Co., Asher being the other member of the firm. Allegation is now made that Wollenberg, for a half Interest In $41,000 worth of claims $20,000 secured $90,000 worth of mort gages that should have been turned over for distribution among the heirs of 8. Marks. The property Involved In these mortgages Includes some of the most valuable land in Douglas County, and has greatly . Increas ed In value since the original ap praisement after 8. Marks' death. CITY OF EUGENE WISH TWO LlyLOH CASES. Judge Harris Gets Double Reversal in Supreme CourtPardcn for a North Bend Mao. SALEM, Or., March 9. The city of Eugene won today In the Supreme court in the case of W. C. Gay, res pondent, vs. City of Eugene, appel lant, a review case. In which Gay sought to overthrow the proceedings by which ho was convicted of Eelllug liquor In violation of the local option law. The docree In Gay's favor by Trial Judge Harris is reversed In an opinion by Chief Justice Moore and the writ of review dismissed. A similar victory for the city of Eugene was awarded In the case of W. R. Gu'e, respondent, vs. City of Eugene,. appellant, also a liquor case, in which Judge Harris Is reversed in an opinion by Chief Justice Moore. The Supreme Court withdrew Its opinion In the case of State of Ore gon, respondent, vs. J. C. Wilcox, appellant, from Coos county, J. W. Hamilton, Judge. The case was af firmed on February 9, and has been pending on rehearing. Governor uiiaiiiuenuin recently granted a par- aon in tavor oi wticox, and for this reason tho original opinion, which has been challenged by the district attorney.
