POnTLAND, Or., Nov. 20. Judge
Wolverton yesterday afternoon over
ruled the demurrers filed by Job Gil
pin and IxhiIh Kohlhagen, of Hose
burg, two of the seven men indicted
for perjury In connection with an at
tempt to locate timber claims on land
In Southern Oregon, after the land
had been taken up by homesteaders.
Judge Tbornaa O'Day appeared for
the two defendants and arguments In
behalf of the government were made
by United States Attorney McCourt.
Judge O'Day attacked the validity of
tho indictments upon two grounds,
tlrst, holding that the Indictments
were not warranted by the facts; and,
second, because two separate offenses
were named In a single count.
The indictments charged Gilpin
and Kohlhagen, together with the
five others, with perjury. In that they
swore when 'they made their filings
that the lands In iguestlon held no
improvements, while It was well
known that the claims had been
taken up and were under cultivation.
The lands in question are located in
Josephine county, In township 24.
When the township was surveyed a
number of homesteaders squatted on
the land, waiting for the government
to throw It open for settlement.
In spite of the fact that the squat
ters had 'taken, up the lands two
weeks before It was thrown open,
the men under Indictment, it Is alt
legod, formed a line In frout of the
land ofllce and made filings on the
claims, In spite of the fact that the
Inw gives the bona fide set-tier 30
days In which to'make his filing.

Paget, treasurer of the prohibition
party's organization in Oregon, has
forwarded a statement of the ex
penses of his party during the recent
campaign to the secretary of state, as
provided by 4he corrupt practices act.
The statement shows the total outlay
to have been $500.08, of which
amount over $00 Is still owed by the
prohibition party.
Since the statement Is not accom
panied by a proper affidavit as re
quired by the Huntley enactment, Mr.
Paget will bo asked to comply fur
ther with the law. No other party
treasurers have attempted to comply
with it.
A. C. Marsters and F. W. Kercher,
presidential electors, have written
letters to the secretary of state In
which It is said they expended noth
ing during tile late campaign. Their
statement will also have to be sworn
to In order to comply with the act.
No candidate or party treasurer
has properly complied with the cor
rupt practices act. in this regard and
the lawful time for filing statements
of expenses hns passed.
