Kugene Register: Tho validity of
the near-beer ordiiuaneo and the
right of individuals to sell that
beverage In "dry' counties will he
tried before Judge Wolverton In the
federal court at Portland on Satur
day or this week. This is brought
about by the anxiety of tho Itosehurg
Brewing and Ice Co., who are behind
Charles Kuthe, who is under arrest
for violating the ordinances of the
city. The brewery company wants
to get action on the matter as quick
ly as possible, so that if they are al-
owed to sell near-beer In dry
counties they can get a decision and
;et busy. If the case were brought
In the circuit court the merits of the
ordinance might again be temporarily
overlooked and the matter be no
nearer a solution than before, and
then the council might pass another
ordinance If this particular one
does not cover the case, and endless
litigation result before they got their
goods legitimately upon tho market.
It has been determined, therefore,
by Pipes & Pipes, who are conduct-
ng the case to go at the root ot
the matter by testing personal rights
under the constitution In the United
States court.
