Sheriff Feuton was called to the
stand to Identify the character of the
liquor contained in the flask which
DuRobln claimed to havo purchased
from Fa be. The process of examin
ation by the officer was as follows:
First, he looked at the liquor.
Second, he Bmelled of It.
Third, he touted of It. (Longing
sighs among the spectators).
"What Is It?" atked the district
attorney.
"It's whiskey," replied the sheriff
with emphasis.
"Good or bad?"
"Fair quality,"
"Is It Intoxicating?"
"Yes."
Henry RPznian, a local plumber,
followed Mr. Fenton on the stand.
The prosecution wanted to prove by
another alleged offense on part of
Mr. Falbe, of which the witness was
supposed to be cognizant, that he was
In the habit of selling intoxicating
liquor. The defense Interposed an
objection, which was sustained by
the court.
Testimony of Defense.
Eleven witnesses In all were cal
led by the defense. The first of tnese
was Falbe himself. He swore that
DuRobln had approached him on
two different ocaslons for liquor and
that he Informed him each time that
ho did not carry such stuff In his
house, neither did he know where It
could be obtained. Mr. Falbe stout
ly denied that he had ever carried
liquor In his place of business or
sold any since the prohibition law be
came operative. In this statement
he was corroborated by Mrs. Falbe,
who testified that she spent most of
her time in her husband's place of

Hoover were called by the defense to
testify as to Falbe's reputation for
honesty nnd Integrity and every one
of those witnesses stated that those
qualifications of Mr. Falbe's char
acter wore good. The defense also
attempted to prove by several of
them who had boarded at Mr. Falbe's
restaurant that no liquor was sold In
his plnce of business, but Judge Ham
ilton sustained the objection of the
prosecution, holding that such evi
dence would be only of a collateral
nature and not bearing directly upon
the specific case at bar. Staples was
asked If DuRobln hud tried In induce
him to buy liquor of Fnlbe, but the
prosecution again objected and was
sustained by the couif. Gtlvin, who
formerly conducted a "near beer" es
tablishment In this city, was asked If
DuRobln had attempted to buy intox
icating 'liquor of him and before
Judge Hamilton could rule on the
tnrdy objection of the prosecution
the witness answered "yes." The de
fense then rested.
DuRobln wsb called by the prose
cution of rebuttal ot Falbo's state
ment to the efT oct that he (DuRobln)
often puld him for .more than one
meal at a time during the period that
ho boarded at the restaurant. The
object of the defense In calling forth
this stntement from Falbe was to
show that the extra 60 cents which
Dultobln paid Falbe on the occasion
when the liquor was alleged to have
been purchased was for meals and
nothing else. DuRobln contradicted
this statement, declaring that he In
variably paid for his meals as he ate
them.
After arguments by the attorneys
for the state and the defense, and
Instructions by the Judge as to the
law applicable to the case, the Jury
retired for deliberation at 3: 50 p .m.
At five o'clock the Jury was still out.
Ihe other Jurymen were then ex
cused until ' o'clock on Monday
morning wnen the case of Scott Jef
ferson, of Yoncalla, will be called for
trial on an Indictment for violation
of the local option liquor law.
No reports have been filed by the
grand Jury for the past three davs.

The addition of a new case to the
docket this morning formally usher
ed In a legal fight for the possession
of Delbcrt V. May. an 8-year-old boy
and son of H. D. May, the local meat
market proprietor, who Is the de
fendant. The case In legal phrase
ology a petition for a writ of habeas
corpus has been Instituted by May's
first wife. Ada V. May, who obtained
a divorce from him in Columbia
county, Wash., In February, 1907.
In her petition, Mrs. May sets forth
that the decree of divorce also gave
her the custody of the boy. but that
her husband has him In his posses
sion and refuses to deliver him over
to her. At an Introductory hearing
of the case this morning. Judge
Hamilton allowed the defendant 30
days In which to answer the mother's
complaint, and In the meantime the
boy la to continue In he custody of
his father. Mrs. May Is represented
by Attorneys Elbert 11. Hermann and
Albert Abraham. Mr. May's lawyers
are Coshow ft Rice. The case will be
bitterly fought.
