Another Indictment dismissed was
that against Joseph Ulack and others
in what is known as the "Wisconsin"
case. These men were indicted lor a
conspiracy to defraud the govern
ment of tiinberland lu this slate but
the prosecution was defeated In au
attempt to cause the removal of the
defendauts rroiu Wisconsin to Ore
gon for trial, leather than have the
docket further encumbered by the
case, Mr. Becker caused It to be dis
missed as to all of the defendants.
Mr. Becker also had indictment
Xo. 4849, known as the "Los Angeles
case," dismissed, as against the de
fendants Warren Gllleien, Kobert W.
Kenny, Jacob C. Cross and Ueo-ge L.
Stearns. This is the case in which
the officers or the Pacific Furniture &
Lumber compuny and their agents
were indicted for seeking to rob the
government of nearly 9000 acres of
tiinberland in Curry county.

The grind of the land fraud cases
will be resumed Monday, October 2,
when Mr. Becker has arranged lor
tho trial of the Pnclllc Kurnitnr3 &
Lu rubor company case. The trial or
this case is expee'ed to occupy fully
four weeks, as the government lias
approximately 2000 letters relaung
to the alleged conspiracy and winrh
probably will ba offered as exhibits.
Following this case, the trial of Hin
der Hermann-wili be taken up, a
postponement of this trial from the
October term for which it had boon
set having been ugreed to by the
government at the request of A. S.
Worthlngton, chief co'utsel for 'ler-

abroad and will not return until fall.

represented Mr. Alley, who was par
ticularly desirous of an immediate
trial. Owing to the fact that three
cases had already been set for trial
and probably would take up severa.
weeks, Mr. Becker declined to Indi
cate any definite date for the Alley
trial, although he assured Mr Malar
key that the case would be called
just as soon as it was possible. At
the same time he advised counsel for
the defense thnt the government had
failed to apprehend two of the de
fendants in the case and until they
had been located and arrested the
government desired to proceed cau
tiously lu the prosecution of the
charge. Mr. Malarkey point out that
his client, prior to his Indictment,
was an extensive practitioner as land
ollice attorney, but during the pen
dency of tho indictment and the trial
thereunder he had been suspended
from tho practice and practically cut
off from the vocation on which he de
pended largely for a livelihood. The
only sntisfnteion Mr. Malarkey re
ceived was that the case against Al
ley could not be called until after the
Pacific Furniture & Lumber Com
pany, Hingor Hermann and William
son casus had been tried.
Alley was Indicted with A. R.
Downs and Kdward H, Downs. The
Messrs. Downs have left the vonn
try and were traced by government
agents as far as Mexico. They re
entered the United States, but before
the government could capture them,
they had slipped back across the line.
As Alley Is the only remaining de
fendant, his enso has been put over
and will probably eventually bo dis

It was expected that a larger
number of the Indictments would be
dismissed yesterday, for it has been
regarded for some time that the gov
ernment did not Intend to prosecute
all that were returned by Honey.
That more of thorn wore not dropped

the fact that the prosecution Is rely
ing on a number of these defendants
as witnesses against Hermann. No
chances will be taken by the govern
ment, and It Is not expected that any
of the other indictments will be dis
