Portland, July 18. After the in
. traduction of testimony by tbe deteose,
in tbe Williamson-Van Gesner land
frauds case today, to show the charac
ter of tbe timber claimsn question, U.
S. Attorney Heney betran his argument
to the jury, for the prosecution. He
will be followed thisafternoon by the
attorneys for the - defense.
WAIVES RIGHT OF ARGUMENT.
This afternoon the defense in tbe
case of Williamson-Van Gesner, et. al.,
sprung a surprise by waiving their
right of making a final argument to
the jury. A recess was taken by the
court until three o'clock to permit
Judge De Haven to write bis instruc
tions to tbe jury. As soon las his
charge is delivered, the jury will retire
to formulate their verdict.
POINT AGAINST WILLIAMSON.

John Newton Williamson was on the
witness stand in the United States
Circuit Court all forenoon Monday.
His testimony was the feature of the
day's proceedings and bis cross ex
aminations was a feather in the
cap of the Government. Tbe defense
has contented that Williamson was at
Prineville only for a short time in July,
' 1002, and when tbe same thing was
affirmed on tbe stand by Williamson
he was confronted by District Attorney
Heney with the register of the Poin
dexter Hotel, in which under date of
June 15, 1M0, was to be found the Big
nature of John N. Williamson. Tbe
Congressman said that the signature
was not his own, but be confessed that
tbe name "Prineville," appeared to be
in hiB hand writing. Moreover, he was
not prepared to swear that be was not
in Prineville at that time. This ma
terially strengthened the Government's

the defense that Williamson was not
in Prineville.
This point bears out the theory of
the Government that Williamson was
in Prineville more than two weeks be
fore tbe filings were made; that there
was a perfect understanding between
the defendants; that he arranged with
bis wife to file, and that he then went
back to Tbe Dalles and negotiated a
loan to make payment on tbe claims
and caused bis wife to file shortly af
ter his departure.

about 77 years.
He was an old settler of this county
and is survived by lits wife and a large
family. (Obituary later.)

Russia Thinks Powers Should

St. Petersburg, July 17. The No
voe Vremya today prints the following
statement of Russia's position, which
may be inspired:
"Russia can consent ouly to such
peace as will not affect tbe dignity or
vital interests of the empire. To act
otherwise would be fatal to Russia and
would threaten all Europe. Europe no
longer believes in Japan's assurances
that she wilt not restrict European in
terests in the Far East. Even in Eng
land and America the voices of moral
instigators can be heard in favor of the
indirect Influence of the powers to
moderate Japan's demands. Our pleni
potentiaries must remembsr that they
must defend the interests, not only of,
Russia, but also of other Caucasian j
powers, and they will find moral sup
port In Berlin, Paris, Washington and
perhaps even in London. Our army in
the field is much stronger than it was
15 months ago.
"The Hamburger Nacbrichten pro
poses that Europe intimate to Japan
that extreme demands will be resisted
by Europe in general, especially Ger
many. This is a valuable statement.
We must ascertain the acceptable
maximum of our concessions to Japan
from a European point of view and act
accordingly."

George Kenny Red'fer was born in
Hickory Co., Mo., on Feb. 24, 1882,
and died at Portland, Oregon, from ty
phoid fever, on July 11, 11)05.
He was a irue and devoted son, a
kind and loving husband. He was

Banks I Stand," and "My Latest Sun
is Sinking Fast," and then he said, "I
am ready to go."

HARVEST OF DEATH,
Train Accidents Kill 232 and Injure
3713 in Three Months.
Washington, Ju'y 17. Accident
bulletin No. 15, just Issued by the Inter
state CommerceCommission, giving an
account of railroad accidents in the
United States during the months of
January, February and March, 1005,
shows that during the quarter 28
passengers and 204 employes were
killed, and 1051 passengers and 2062
employes were injured in train acci
dents, making in all 232 persons killed
and 3713 injured in train accidents.
Other accidents to passengers and em
ployes not the result of collisions or de
railments bring the total number of
casualties up to 000 killed and 14,397
injured.

Indian Dies Under Train.
Pendleton, Or., July 18 Ka-Moo,
and Indian alottee of tbe Lapwai
Reservation in Idaho, was run over by
a freight train on the O. R. & N. a
mile east of the city last night and
Instantly killed. Before the tragedy
was discovered another train had run
over the Indian, his body being ground
to pieces.
It is believed that the Indian was
drunk and was lying on the track
asleep when run over.

Intense Heat in The East.
Chicago, July 17. Three deaths oc
curred today as a result of the Intense i
heat, and there were many proBtra- 1
tlons. Yesterday's mark of IW degrees
was reached before noon, today, and
there Is no relief in sight. I
St Paul, July 17. Nine persons
were drowned and three deaths from
heat occurred in St Paul and Minneap
olis in the last 24 hours. The drown
ing resulted from an accident while
bathing.
Lincoln, Neb., July 17. There is no
cessation of the terrific heat in Ne
braska. It Is 1)0 degrees hero, and tbe
corn crop is badly scorched.
Mi NOT, N. D , July 17. The heat
throughout North Dakota Is terrible.
Many prostrations are reported. Stock
is suffering and crops burning from tbe
beat.
