Congress man Binger Hermann, of Oregon, was today Indicted by the Federal Grand Jury of the District of Columbia, which was convened in special session upon ruest oE District Attorney Francis J. Heney. The in dictment against Hermann charges him with unlawfully destroying, while commissioner of the general land of fice, 25 letter press copy books con taining olticial records, the alleged purpose of which was to obliberate evi dence implicating Hermann in the no torious Oregon land frauds. Secretary of the Interior Hitchcock was one of the witnesses against Her mann. (When previously faced with a simi lar charge, Mr. Hermann claimed the books destroyed only contained copies of bis private correspondence.) ry R. Commission Bill Passed. Olympia, Wash. March 2. Charged With Obtaining Honey Under False Pretenses. San Francisco, March 2. Harry W. Miller, of Roseburg, Or., was brought before Commissioner Eeacock under indictment In tbe Federal Court for obtaining money under false pre tenses. He is accused of having sub orned men to file on lands In that state and make false filing attidavits as to in tention and as to whether or not the land was being taken for individual use and benefit or for speculation. He will be placed under $3000 bonds to insure his appearance at the next term of court. (Miller was one of the men Indicted by the Oregon grand jury for extensive timberland frauds perpetrated in the vicinity of Medford. He, in company with Frank E. Frater, arrested last October for the embezzlement of United States Postal funds while postmaster nt Roseburg, was arraigned before Judge Bellinger yesterday and entered a plea of not guilty. Frater, who is an aged G. A. K. vet eran, was indicted by tb": Federal grand jury under two counts, the embezzle ment of M32.5S nd ti"8.44. It is the impression that while having been found short in his cash to the extent of these two amounts, there was no crimi nal intent, but rather a failure to ob-1 serve postal regulations and an ant of 1 strict business experience. Washington, March l.-Mn answer to an inquiry on the subject, Secretary Hay has formally assured the Haytian Minister here that tbe United States Government has no intention whatever of acquiring by annexation or other wise, purchase Hayti or Santo Domin go, nor of extending American influ ence In that direction. The correspondence that passed be tween Secretary Hay and Minister Leger is dated last month and Is as fol lows: "Department of State, Feb. 6, 1905. Dear Minister In answer to your in quiry made this morning, it gives me pleasure to assure you that tbe Govern ment of the United Stales of America has no intention of annexing either Hayti or Santo Domingo, and has no desire of acquiring possession of them either by force or negotiation, and that even if the citizens of either of these Republics should solicit incorporation into theaAmerlcan union, there- would be no inclination on tbe part of tho National Government nor in the sphere of public opinion to agreo to any such proposal. TOKIO, March 3. General Kurokl, commanding tbe right wing of the Japanese army, reports that he has driven the Russians out of three po sitions and Is now bombardinga fourth, where he is opposed by a battery of 60 guns. General Oku, commanding tbe'jleft wing, reports under yesterday's date that he oponed a terrific bombardmont along the entire line. His 'guns, a hundred all told, include the largost ever used in a Held action. So great was the damage Inllicted on tho Russian positions at last accounts that the enemy's guns were unable to reply. A third report from tbe front soys Oyama has completely blockod Kufo patkln's attempt to execute a turning movement to offset the turning of his left wing by General Kurokl. The report adds that the Japanese are now only a few miles from Mukden and that the battle haB reached Its fiercest stage. ' STItUOOLE AT PUTILOFF HILD. oak HU Tun, Manchuria, Marob 3.-- Following the frightful bombardment at Putlloff (Lone Tree) Hill yostorday, the Japanese made a determined effort to take the eminence at the point of the bayonet. They made two desperate assaults, but wore repulsed both; times by a torrent of sharpnel and rlllo lira. The bombardment of tho hill has been resumed. The Japanese advance on the loft bank of the Hun river was met with stubborn resistance. Four Japauese divisions advanced to witbin eleven miles of Mukden, where they were checked by Russian reinforcements. General Kogl's Port Arthur veterans are participating in today's battle. The losses on both sides arc enormous. SITUATION TO DATE. ST. Petkhsiiukq, March 2. The position of General Kuropatkln's army is regarded as being more or less critical. The real turning movement which General Kurokl is operating in the mountains 40 miles eastward of Mukden seems to be making progress, and at the same time Field Marshul Oyama is also rolling back the Russian loft, while pounding away at tho Rus sian center with heavy high-power guns. Poutiloff and Novgorod Hills have been subjected to a continuous three-day bombardment, followed by an Infantry attack, the main Russian lines being forced to retire two miles to their sheltered trenches. Some of the Russians newspaper correspond ents anticipate an attempt to take the bills by storm. General Kuropatkln Is making des perate efforts to chock Kurokl, ono of whoso columns has succeeded In work ing around the extreme Russian left, and reinforcements have been dis patched in a northeasterly direction. General Rennenkampf Is slowly re tiring, fighting, taking advantage of the broken, hilly country and contest ing every Inch of ground. While the Japanese are evidently making progress, there is nothing yot to indicate that Field Marshal Oyama will succeed Jn Inflating a decisive blow even if he foi'ces Kuropalkin to aban don Mukden.
