McCoy, deceased; order of the county court admitting to probate the last will and testament of said decedent, in-so-far as it concerned Mrs. C. J. Denning, reversed. This was a suit instituted by Wm. A., S. D., and J. H. McCoy, brothers of Mrs. Denning and also heirs of J. J. McCoy, 'deceased, to prevent her from acquir ing full possession of the wj of lots 7 and 8, in block 8, Railroad Addition to Roseburg, on which her husband now conducts a hotel. In her petition to the county court, Mrs. Denning al leged that this property was bequeathed to her exclusively by her late father, but that his will embodying this pro viso was lost. Thu will was drafted by lion. J. S. Fitzhugh four yeuis prior to Mr. McCoy's death, and then, accord ing to the evidenco accepted by Judge Hamilton, the document was given to McCoy. That appears to be tho last evor -seen of the will from which Judge Hamilton infers, pur suant to a presumption of law, that Mr. McCcy either revoked or cancelled tho instrument. Hence, the order of the county court establishing the will Is reversed . Willis Kramor vs. Wm. P. Johnson Lumber Co., writ of Injunction re straining defendants from interfering with tho nuturul iiow of the waters of Myrtle Creek. The defendant com pany operates a saw mill six miles from the town of Myrtle Creek on the stream bearing that name. A Hume has been constructed from the saw mill to a point in the town about 100 yards from whore tho plaintiff operates flour mill, said mill being depend ent upon operating power from the waters of Myrtle Creek. The stream is partly diverted Into the flume at the sawmill and then discharged Into the race leading to the Hour mill. A series of dams wus constructed above the saw mill to consorve the waters of the creek for sevorul days at a time, tbe natural flow being lnsulllclent for log ging operations. Tho plaintiff set forth that these irregular conservations of the water above the sawmill serious ly hampered tho operations of his Hour mill; that furthermore, whon the water was discharged from the flume into his mill race, It would contain sulllcient debris to olog the wheel at the Hour mill. Judgo Hamilton, in his decision, held thut Inasmuch as Mr. Kramer and bis predecessors had used the waters of Myrtle Creek uninter ruptedly for 40 yoors, that the lumber company's action was an invasion of Mr. Kramer's rights. Judge Hamil ton's Injunction restrains the lumber company from preventing the natural How of wator of tbe creek by means of dams, Humes, or In any othor man ner. Harbit, who has been suffering with neuralgia, went to Oak land to see the doctor, and had some teeth extracted. News was received here this morning of the death of Guy Fleming and BertGarber, two miners employed at the Simmons Hydraulic Mine, of the Waldo district, Southern Josephine County. The two men wore working In the diggings beneath a high bank when a slide of many hundred tons broke 'rom the bank and, falling suddenly, caught tho two men before they could get from beneath it. Their comrades worked heroically to extricate them, but both men were dead when uncovered from the great muss of gravel and dirt in which they were entombed.
