County Court Cases,
The docket for the coming term of
circuit court has been enlarged by the
.three following cases, just filed:
S. M. Kelly and John Banks vs. A. E.
i Kent; action to recover $1000 damages
,' for alleged violation of contract. The
plaintiffs are members of the well
known livery arm of Kelly, Banks &
Co., of this city. In their complaint
they allege that when they purchased
their uresent business from Mr. Kent,
he agreed not to again conduct a livery
business in Roseburg while the plain
tiffs were so engaged; that in violation
of this agreement he is actively en
gaged In conducting a livery business
in Roseburg at the present time. The
plaintiffs further allege that it was
stipulated in the agreement that If the
defendant broke his pledge he would
pay 91,000 as liquidating damages,
which is the amount in which they
accordingly ask judgment. (Ttie busi
ness In question is now in charge of

Mrs. Emma Lough vs. Fred V.
Lough, her husband; action to recover
$545, which the plaintiff claims belongs
to her, and which was given to her
husband by a third party for delivery
to her in September 1903, from which
time she also asks interest on the
amount sued for. She has caused an
attachment to be levied against the fol
lowing real property of the defendant:

, The plaintiff alleges that he entered
Into an agreement with the defendant
whereby the latter was to deliver a
deed to the form r on the defendant's

in lumber; that prior to the agreement
he erected a sawmill on the homestead
and incurred other expenses to the
amount of $1000: that Mr. Perdue after
getting from him 972.H1 worth of
lumber decided to repudiate his con
tract. The plaintiff says he has offered
the defendatit the amount due him in
cash, together with interest and tuxe
on the property, but the defendant
refuses to accept, wherefore he asks
the court to close the contract.
