tions set forth are : That the city charter
of Roseburg provides that except ' for
sewers and bnlldlng a city ball and Jail
the city of Rosebnrg shall not Incdr an
indebtedness exceeding (5000. That tbe
counoil wrongfully and unlawfully en
tered1 into a contract with tbe Rosebar g
Water & Light Co. for lighting the ch;
for a term of ten yeais at A compensa
lion of (125 per month, although by let
ting the matter by bids the service could
have beon secured for a sum not exceed
ing (80 per month. That such contract
oreatea a debt and liability of said city
In the sum of (15,C0O, and that outside
of a bonded indebtedness of (95,000 for
contraction of sewers and city hell and
jail tbe oily ndw has a current indebted
ness of (16,000 which Is drawing Interest
at 6 per cent per annum. The plaintiff
therefore prays that the contract be set
aside and declared void, and the mayor
and city council be perpetually enjoined
from issuing warrants to the Rosebnrg
Water & Light Oo. for lighting the city
under said contract, and likewise enjoin
ing the city treasurer from endorsing or
paying any such warrants, and for his
costs and disbursements iu this action.
Dexter Rice and F. W. Benton are at
torneys for the plaintiff, aud the matter
will be beard before the circuit court at
tbe regular term in May. '- "

ent session a resolution providing for
tbe election of senatora by direct vote of
the people. Ibis, together with a simi
lar reaolntion adopted by the house bad
been referred to tbe committee on privi
leges and electiors. The house had
passed such a resolution four times, but
the question never had been considered
by the senate. He was being pressed
constantly, be said, by correspondents to
know when a vote would be taken upon
tbe question by the senate, and he de
sired to inquire of the chairman of the
committee whether tbe senate could not
have a vote upon the subject during the
present session.
Burrows (Mioh.) chairman of the com
mittee on privileges and elections, after
saying what Berry said was true, said :
. "I will say to the senator that there is
no disposition on the part of the com
mittee to shirk responsibility in connec
tion with the resolution. Action npou
it will be taken, and a report upon It
will be made."
"In time to take a vote upon It at this
session?"
"I bare no doubt of it," replied Bur
rows. ..

Mitchell's Chinese Bill.
Washington, March 12. The Imrr'-
gration committee of the senate is
about ready to report tbe Mitchell Chi
nese exclusion bill. Senator Mitchell t -
day had a conference with Chairman
Penrose, and was assnrsd that tbe bill
would be changed but slightly, and not
in a manner to alter its general effect.
Most of the changes contemplated are as
to phraseology. This is somewhat of a
surprise, at it had been supposed the
committee would favor a bill following
largely the provisions of the present
Qeary law. On the contrary, the com
mittee's report will provide for practi
cally all the Important features of the
more stringent Mitchell bill. .
