Charged with assault with intent to kill, John Stancllffe was arrest ed this morning on a warrant issued from the JuBtice court. Stancllffe Sunday night attacked McKlnley Merely striking him a severe blow on the head which has resulted In a serious wound, and which may prove fatal. A hearing will be held tomorrow morning in the justice court. The assault was caused by Morely's continued attentions to Stancliffe's wifo. The fight occurred Sunday ev ening near the top of Winchester hill, according to Morely, ho was on his way home after having Bpent the afternoon In .Mrs. Stancliffe's company. When he noticed the wo man's husband following him, he waited and the two engaged In an altercation which finally lead to a pitched battle, during which More ly received a lent 'over the ,eye which he claims was Inflicted by a stone, Stancllffe claiming, however, that he struck hlin only with his fist. ' The seriousness of the wound was not realized at first, although More ly went to Dr. Hoover to have It dressed. The following day It had swollen and discolored his face ana It was found neccBsary to re-open and drain the cut. , Last night he became unconscious and has been de lirious a great part of the time. John Stancllffe and his wife were I married November 7, 1914, and liv ed together until about nine months ago. Since that time, however, they have been separated, although neither had started suit to obtain j a divorce. Since they separated John claim thnt Morely has been I keeping company with his wife and ' that at one time a reconciliation i was almost effected when Morely ex- orted his Influence and prevailed j upon Mrs. Staucliffo to refuse to return to her husband. At that time Mr. Stancllffe clnlms that he warned Mr. Morely to stay away from the woman which he refused to do, although he has been warned several times since. According lo the statements made this afternoon by Mr. Stancllffe hej met Moresy on Jnckson street Into Sunday evening and followed him to the top of Winchester street when tho latter stopped and waited for him. John says that he repeated his warnings and that they finally en gaged In a fistic combat. His hands bear evidence that the fight was a ! hard one as his knuckles arc badly ; bruised and cut. It Is claimed by Merely that ho ' was struck by a rock which inflicted the injury, the cut being about an Inch and a half in length. He says he was then left by stniirllffe and that he came hack to the office of Dr. Hoover where he had the cut dressed.
