Hillard & McOinniB, the Portland paving contractors who during the lust summer laid several blacks of concrete pavement in Roseburg and Sutherlln, today made a voluntary as signment . to , Hie lattor's father Charles P. McGinnis, of Portlands It is said that the assets of the com pany approximate $100,000, while the liabilities will exceed that amount by a few thousand dollars. Hillard & McGinnis have done much work in Douglas county dur ing the past summer, and roughly estimated their contracts in this city and Sutherlln totalled J30.000. While it was known for some time that the company's tneasurer was slow in remitting claims, not until a few days ago did the banks upon which the company drew its checks return them under protest. The assets of the company Include considerable paving machinery, while the liabilities are made up of unpaid bills, both local and 'foreign. At present Hilliard & McGinnis have sev eral substantial contracts, including the construction of a sewer at Port land from which they will realize $40,000. Charles P. Harth's Toggery, inc. murderer of Donald Stewart and George Hastings, met almost instan taneous death lu the dark execution chamber of the penitentiary, near this, city, today. Frank Garrison, who killed Roy Perkins, in Coos county, lato in Aug ust, 1910, and weighted his body in the buy, and Noble Kanlder. slayer of Lewis Gilbert, mounted the scaf fold at about 11:30 o'clock, and less than teu minutes later they darteil through the death trap and into eter nity. Garrison was pronounced dead at 11:54, while FauUlor was pro nounced dead two minutes Inter, Contrary to expectations, Frn:m Garrison did not dtdivcr the 10 minute address which he prepared and submitted to the warden of the penitentiary a few days ago. Just before the trap was sprung Garrison said a few words in which ho declared that he was in nocent of tho crime of which he wai twice convicted, "t was convicted of the murder, of Hoy Perkins through perjured testimony," declnred Garri son, "and I am now condemned to die for the crime committed by an other person. 1 want to say that I did not commit tho murder of Roy Perkins of which I was convicted. There were false witnesses," tuntin uod Garrison, when his voice broke ind ho stood choking. "Gentlemen," he continued, "1 have prepared a statement which will be given to the press." When the noose was being placed about Garrison's neck he routed, "Not so tight," and cried as if he was but a child. Kaulder, the Klamath Falls mur derer, appeared little excited as he took his place over tho trap beside his cell companion, Garrison. In fact, Faultier presented a picture of a jier son unaware that he was soon to cross the divide and face his maker. Just before the trap was sprung. Faulder raised his head and peering Into the space remarked: "Goodbye, everybody, goodbye. Hanging will never cure crime,, you must got at the root of the evil." The trap which sent Garrison and Faulder to death was sprung at 11:39, and at 11:56 one of the doc tors pronounced the men dead and ordered them cut down, As the bodies of Garrison and Faulder were being placed in wooden coffins in the Jail yard, Mike Mor gan and Roberts appeared. Roberts hailed the guards In the yard and remarked: "Well, bo long, fellows." Roberts and Morgan were preced ed by Father Moore, of the Salem Catholic church, and tho three chant ed Joyfully as they nenrcd the death chnmhe.v Father Moore spoke briefly In be half of Morgan, whom he said shot in Belf-defenBe. Morgan had nothing to say on the gallows, neither would he converse with those about him. Roberts made a rambling state ment, in which he said ho was hound ed by the officers and had not been given a square deal.
