street lumber yard, and subsequently

In his comp'aint, that the W. R
Johnson Company did not own the
bruch yard.
Joltnsou last night said that Mar
nell was merely endeavoring to col
lect by criminal process money he
had Invested In the company. John
son declared that he had never rep
resented t he Church-street plant an
part of the property of the Johnson
Company, that, on the contrary, Mar
nell had known all (he time that it
was known as the Noe Valley Lum
ber Yard and was the pei-Honal prop
erly of Mrs. T. C. Leltoy. Johnson
expressed himself as anxious to face
the charge brought by Marnell, and
said that he would he In court this
morning with documents to prove
that no Traud had been committed
or misrepresentations made to Mar
nell. Johnson surrendered himself
last night, and was released on bonds
in the sum of $:.oo.
