Mr. Honey Bald R would not take him longer than 20 mlnu.toB to present the opening statement of the case for the government. Probably a some what longer time will ha required by the defense, so Hint it Is expected the major pnrt of tint morning session to day will bo taker, up In this way. He fore excusing the oilier jnrt.rs for a dellulte period. Judge Wolvorton In quired of Mr. Ileuey for Information as to how much time would be re quired (o try the Hermann ease. The government's prosecutor answered that he did not think more than two weeks would ho required to try the Hermann case. With tills under Ktandlng Judge Wolvorton excused all Jurors, not drawn on the I ler miiuu case, until Monday, January 111, at 10- a. in. It is generally regarded doubtful that the Hermann trial can he con cluded In two veeka U involves substantially the same testimony and many of tho same witnesses called In the trial of Jones, Mays and Soren son for their part. In the same alleg ed conspiracy. It. will be remember ed that, this trial took about three weeks. Forty Witnesses Here. It was not announced yesterday hy Mr. Honey who will be the first wit ness for the government. However, about 40 residents of the eastern Oregon counties that were proposed to be incorporated in the lJlue Moun tain forest reserve have arrived In the city and are quartered at the difierent hotels. In the Mays-Joiies-Sorensoh case, theco witnesses tes tified chiefly as to the turn timbered character of the land within the boundaries of the proposed reserve. It Is supposed they will give the same testimony In tho pending caso. Mays Is in the city and probably will he one of tho witnesses for the government. It Is a reasonable cer tainty that George Sorenscn will also testify for the prosecution. Although Sorent'on was convicted jointly with Mays and Jones in thia same case, ho lias not been sentenced for the part, ho played in the conspiracy. Henry Meldrum and Salmon M. Ormsby ire among others connected with the land fraud prosecutions who have ar rived In tho city. Ormsby was the agent for the government who Inves tigated the proposed reserve and rec-. oinni"iu!ed to the Interior depart ment that It be established. For his part In the r.cheme Ormsby Is said to havo received two quarter sec lions of school land, Included within the reserve, as proposed which he disposed of fcr $1,000 In onsh. Stubborn right Due. When the lurgo number of witnes ses summoned by the government Is taken Into consideration, it appenrs altogether doubtful that It will he noBsihe to conclude the I rial within the fortnight predicted by Mr. He-1 ney. If nuything. the Hermann trail j will ho foimht more stubbornly than was the original hearing on this in dictment, when the conviction of ! Mays, Jones and Sorenscn was so-1 cured. It would not. be at nit sur-1 prising If a month elaj sea before the case finally goes to ihe Jury. Iho name of ! . W. (".lack ) Ma- ihews. commander In chief of the Ni;W TODAV.
