PORTLAND, Nov. 16. John Mc
Court, U. S. District Attorney, today
con tinned the announcement made
yesterdny that Heney would return to
Portland as Assistant Attorney Gen
eral to prosecute the Oregon land
fraud cases, the most Important one
of which is against Binger Hermann,
against whom an indictment stands
charging him with trying to secure
land fraudulently in the Blue Moun
tain Reserve. About thirteen cases in
all are to be tried.

Downs, a lumberman, went home to
his wife from whom he had been sep
arated late last night with the hope
of effecting a reconciliation with his
wife. He found Roland Fletcher with
the woman. Drawing a revolver he
fired four shots into Fletcher's body.
He surrendered to Marshal Jernigan,
and while he was telephoning for a
coroner, Downs drew a second pistol
and fired a bullet through hiH own
head, dying instantly.

NEW YORK, Nov. 16. Giuseppe
Marek and thirteen other Italians
have been arrested today accused of
selling counterfeit $5 ' bills. Detec
tives allege the counterfeit money
was made in Palence, Italy, and ship
ped to this country in olive oil cans.

A matter which Is far reaching in
its effect and of vital importance to
miners particularly, who are operat
ing on unpatented lands, either sur
veyed or unsurveyed, as well as to
the homesteader or squater, was on
hearing before the United States Land
Office In this city last week.
The defendants In the case were
gentlemen from Salem, MeRsrs. K. K.
Newberry, president, and O. A.
Thomas, vice-president, of United
Copper Gold Mining Company, whose
properties are near Merlin, Josephine
county.
They were accompanied by Mr.
Geo. C. Westby, mining expert from
McGill, Nevada, who appeared as a
witness.
The facts In the contest, are that
on the claims of the Unlted Copper
Gold Company is a lot of fine timber.'
An Eastern corporation representing
extensive lumbering interests in the
West, assayed to take possession of
the lands and timber in question by
the scrip process. The Eastern peo
ple, however, made an offer of com
promise, asking the timber to be giv
en them without protest, and for such
consideration they would not Inter
fere in the miners work.
This proposition was refused by the
Salem people, therefore the case was
Hied for contest.
The scrip by which this transfer
of title Is expected to take place, Is
Northern Pacific Railway paper. It
is obtained In some instances at least.
by the rialroad corporation relin
quishing its right and title to a piece
of undesirable land, or to a piece
that may have been claimed by some
homesteader In the railway's limit In
the State of Washington, receiving
scrip therefor from the government.
This scrip Is good way down here In
Oregon, 500 miles from the railroad's
line, and It is with such paper as this
(hat the Extern corporation Is trying
to gobble up properties In Josephine
county and by so doing oust a mining
company who are at work on the
premises and spending their money ,
to develop the resources of the State, i
