wagon, It Is of a decidedly technical
nature. The status of the case, as It
comes before Judge Burnett, briefly
stated, is as follews: The property,
above designated, was sold by E. M.
Crolsan, as sheriff of Marlon county
on an execution In favor of Joseph F.
Cook, the father of the plaintiff In
this action, and In favor of A. B. Hens
Icy, on the 2d day of February, 1892.
The property was purchased at the
wile by the sheriff by A. E. Hcnsley,
and subsequently sold by Henslcy to
the defendant, AV. H. Byars. The
plaintiff, when a minor, through his
guardian, the above named Joseph F.
Cook, recovered a Judgment against
Mliorlll Crolsan for the wrongful con
version of the property in 189J, In this
court.
He now seeks to recover the property
ltelf from the defendant, Byars.
The case Is being heard before the
following named Jurymen: F. A. Ford,
It. G. Pierce, C. W. Knox, Edward
Jones, T. It. Blackorby, Win. woncr,
C. B. McElhancy, Sam Conner, Henry
Hall, S. T. Hobart, Clarcnco Slmeral,
E. H. Flagg.
The evidence was nil got in by 11 a.
m. today, and after legal points were
argued by D. C. Sherman and Tuition
For the desccndant.the court directed
a verdict for Defendant Byars, on the
ground that plaintiff had recovered a
Judgment and conversion against
Sheriff Crolsan for an Interest In the
identical projicrty. That Judgment
had been satisfied, which vested in
Defendant Byars such Interest in the
property, and that plaintiff could not
maintain replevin against tenant In
common. This Is tho end of a long
contest nud no appeal will probably bo
taken.

David Simpson had the poor Judg
ment yesterday evening to bo carrying
In 60H10 wood, and today he Is paying
the -penalty for his recklessness. As
ho was helping himself to a few htlcks,
the tall pile of wood took u slide, and
when Mr. Simpson found himself, his
face was a trltlo worso for scratches.
He really ought to know better than
to work, but It Is an old family habit,
and they must suffer for their folly.
Mr. Simpson is improving this morn
ing, ami will In n few days be nlxmt
again.

cases of W. "W, Hall, accused of break
ing Into the depot at Woodburn on
the night of January 24th, and Albert
Lee, who was nrrcsted and bound over
for the crime of selling a false and
ficticious lottery ticket to Frank Far
ren on November 4, in Salem.

A Stranger Dead,
j A poor laboring man, aged about 50
I years, died at the Crolsan farm, south
of this city, yesterday forenoon. He
was known as "Andy," and has lived
In a cabin on that farm for the past
year. He was reported very 111 yester

Link. His partner, John Robertson,
