Tho most important measure In
troduced ut this session of the Ore
gon legislature is the bill introduced
by the now Speaker Gecr of Marion
in the last legislature. Tho bill then
passed the house and was hung up
in tho senate until too late to bo con
sidered and hodld not become a law.
It was entitled a bill for an act to
increase the powers and further
define the duties of the Hoard of
Itailroad commissioners. As there
has been an almost unanimous de
maud in Oregon that more power
be given tho commissioners, and
that tlmy bo authorized to make
rates of freight, this bill becomes of
great interest at present. Tho selec
tion of its author for speaker of the
house, upon his publlo declaration
that the railroad commipsion be
given just the powers sought to bo
confened by this measure, is addi
tional evidence that entitles it to
prominence as an important bill.
The logic of tho situation anil the
force of the whole discussion have
been to confirm intelligent persons
iu the belief that the house is under
obligation to pass this bill. Hut it
should only pass on its merits, re
gardieas of its political prestige. Its
main provisions are meritorious. It
requires railroad companies to fur
nish the commission a schedule of
freight and passenger rates, and em
powers tho commission to roviso
such rates and determine if minli
charges are just and reasonable, and
whether or not any unjust discrimi
nations are practiced. Tho commis
sion is empowered to enforce compli
ance- with its fixed tarifl'charges.and
punish violations of lis rates. Tho
commission's rates are receivable as
evidence that any overcharge was
unjust, and are made prima facie
evidence of t'jo reasonableness of
tho same. Tito burden is placed
upon tho corporation to show
that the rates made by tho commis
sion, after full hearing, are not just
and reasonable. The following Is
an important section of this bill;
Section 0. That whenever any
common carrier engaged in the
transportation of persons ami prop
erty by railway in this state, and
subject to the provisions of this act,
shall neglect or refuse to comply
with the findings and recommenda
tions of tho commission, as in this
act authorized to bo made, for a
period of twenty days after such
common carrier has been notified
thereof, as in this act rcoulred. It
nliail be the duty of said commission
to bring anaetion or Hint, as tho case
may require, In the proper circuit
court ol the state, In behalf of huoIi
complainant, on tho original case of
complaint alleged before tho com
mission. This bill is carefully guarded to do
no injustice to any corporation, and
at the same time it requires the com
mission to vigilantly oxerciso that
supervision which alone can protect
tho publlo in Its rights upon a public
carrier. It is amendatory of tho
present railroad commission law,
and will bo favorably repotted by
tho present railroad committee of
tho house. That committee Is com
posed of men ublo and intelligent,
and If they recommend tills bill
favorably, It should receive earnest
consideration from both lionises of
this legislature.
