The World to morrow will say: Ex-Governor Frank S. Black has been tendered the offer of the Attorney-Generalship In President Roosevelt's Cabinet for the term beginning- March 4, 1305- Whlle President Roosevelt has not for mally Invited Mr. Black to become a mem ber of his official family, the tender of the Attorney-Generalship has been made In a way that carries with It the assurance of the President that he would like to have New York's ex-Governor In his Cabinet of younger men which Roosevelt is under stood to want as his associates during the new Administration. It is the view of ex-Governor Black's friends both in New York and Albany that he will not accept the Attorney-Generalship, because it would mean sacri ficing a law practice which. It is said, nets" him $100,000 a year, and which his friends say he could retain if Tie should be elected to the United States Senate. For this reason, the ex-Governor's friends assert, he would prefer to take the Senatorshlp. The understanding of those New York Republicans who know of President Roosevelt's plan to prevent a fight over Chauncey 31. DepeWs seat in the Senate is that TV. H. Moody accepted the Attor ney-Generalship only on condition that his term should terminate on March 4 next. It is believed that President Roose velt may invite Mr. Moody to remain in the Cabinet after that date in some other capacity. But this is a point which is in teresting New York politicians very little. Their main concern is whether Mr. Black wllhaccept the Attorney-Generalship. ATTORNEY MUST GIVE IT UP. He Cannot Hold Warrant Due State to Make Sure of Fee. WASHINGTON. Nov. 17. About a year and a half ago Congress appropriated about jy00,000 to reimburse the State of Massachusetts for expenses incurred in fitting out troops during the Civil War, including interest and premi um on gold paid by the state. Previously the state authorities had entered Into a contract with a Washington lawyer to act as state agent in looking after the claim, and agreed to allow him 10 per cent of the amount received. The attorney holds the warrant and refuses to turn it over to the state until his fee of 1160.000 Is paid. The state contends that the fee Is greatly excessive and makes other al legations tending to -show that the attor ney is not entitled to the fee claimed. The Attorney -General holds that the warrant belongs to the state &hd that the attorney has recourse to the courts to es tablish his. rights in the matter. CANAL COMMISSIONER RESIGNS Hecker Finds the Climate Unfavor able' to His Health. WASHINGTON, Nov. 17. Frank J. Hecker has resigned as a member of the Panama Canal Commission. In his letter of resignation sent to President Roosevelt, Mr. Hecker said the climate of the canal zone is unfa vorable to his health, and he felt con strained to resign. The President ac cepted the resignation, and in reply to Mr. Hecker's letter paid the retiring Commissioner a tribute, and expressed regret that his health would not per mit him to serve any longer. Mr. Heck er is from Michigan. President Roosevelt has not consid ered yet the subject of a successor to Colonel Hecker on the commission. There has been some speculation re garding the successor of Colonel Hecker and several names have been suggested, among them Senator Cockrell, of Mis souri, and Judge Charles E. Magoon, who is now attorney for the Canal Commission. FICKLE ARMY OFFICER LET OFF Woman He Jilted Abhors Publicity, and Case Is Dropped. WASHINGTON, Nov. 17. Secretary Taf t today disposed of the case of Lieutenant-Colonel William L. Pitcher, Twen ty-eighth Infantry, by directing the chief of staff to write a letter to the officer. a copy of which will be placed on record and will also be on file as a part of the record of Colonel Pitcher. This officer was accused of becoming engaged to Miss Harold, of this city, and a few days be fore the date set for the wedding un ceremoniously breaking the engagement. In disposing of the case, the letter states that lack of evidence and a desire on the part of the friends of the young lady. as well as the publicity it would bring to other persons, has determined the de partment shall cease proceedings. The letter criticizes Colonel Pitcher, and In closing contains a severe reprimand for the language he used in communications to the department.
