WITHOUT A VERDICT
Jury in Solomon Case Is Un
able to Decide.
EIGHT ASK FOR CONVICTION
Four Stand for Acquittal, and After
Ten Hours of Deliberation the
Members Give It Up and Ask
for Their Discharge.
At 11 o'clock yesterday morning the
gambling case o Nathan Solomon -was
submitted to the jury. At 8:30 o'clock
last night the jury reported that it
was unable to agree and was dis
charged by the court. Four jurors held
for acquittal, the other eight demand
ing conviction.
When court convened, at 9:30 o'clock.
Schuyler C Spencer, on of the defend
ant's attorneys, made the closing argu
ment for the defense. He reviewed the
case and called particular attention to
that portion of the testimony which
showed that Henry E. McGinn drew
the lease for the premises occupied by
Grant, Solomon and Dale, proprietors
of the Portland Club, and formerly act
ed as their legal counsel. Mr. McGinn,
in the course of his argument to the
jury, admitted all this, but said he had
repented.
District Attorney Manning closed for
the prosecution. He commended the
action of Sheriff Word In suppressing
gambling and said the evidence in th
case showed that Solomon was guilty
as charged in the information and
should be convicted. Mr. Manning
made an eloquent plea and was com
plimented by attorneys present at its
close. The crowd in tne courtroom
throughout the trial was exceedingly
large.
MADE VISIT TO CHINATOWN.
Grand Jury Inspects Erstwhile Gambling-Houses
There
The grand jury, escorted by Sheriff
Word, yesterday afternoon visited the
Chinese quarter, and looked through
the numerous gambling places, the
main doors guarding the entrance to
which, were recently removed by the
Sheriff and carted away. The grand
jury also saw other things of Interest
In Chinatown, which may command at
tention in the final report of that body.
Sheriff Word says damage suits by
the Chinese for taking away their
great doors do not bother him. And
also states that some of the Chinese
are putting up new doors, evidently
with the intention of reopening their
gambling-houses. "If they do they are
laying up trouble for themselves," he
said.
INSANE PEOPLE EXAMINED.
Deputy Sheriffs Convey a Number of
Unfortunates to Salem.
The county authorities have been
overrun with insane patients during
the past few days, and it took up the
spare time of a lot of Deputy Sheriffs
yesterday to convey a number of these
people to the asylum at Salem. The list
included Mary E. Tllden, Miss McGee,
the street preacher, and Mary B. Hard
man, all former Inmates of the institu
tion. E. Jm Pietzsch, who has also been
in the asylum before, recently entered
a barber shop, and, after staying
awhile jumped up and ran out onto the
street with his face covered with
lather. At the time of his arrest he
asked the officer what street he was on
in Salem, imagining he was in that
city.
Benjamin Joslln, an inmate of the
Poor Farm, has recently shown signs
of Insanity. The police "brought In
Thomas Canient as demented, and R.
D. Runyon, who had a habit of haran
guing crowds of people in a senseless
way.
Court Notes.
Suit for a divorce was commenced yes
terday in the State Circuit Court by Ed
ward Schmeer against Maud Schmeer, be
cause of desertion beginning in August.
1902. They were married, in 1901. The de
fendant is now in Texas.
Lcfle W. Sltton was appointed in the
County Court yesterday administratrix of
the estate of her brother, W. W. Spaul
ding, deceased, consisting of personal
property valued at S10Q0. Hepple I. Spaul
dlng, the widow, is the sole heir.
Louis Dammasch, administrator of the
estate of Charles B. Farleman, deceased,
filed a report in the County Court yester
day showing the payment of claims, and
that there is J45S halanco on hand. Farle
man was killed in the Elks' excursion
train accident two years ago, and the ad
ministrator was instructed by the County
Court to sue the Northern Pacific Rail
road. Company for damages. He states
that after a thorough investigation he
finds that under the laws of the State of
Washington, as construed by the Supremo
Court of that State, there is no valid
claim against the railroad company. This
is because Farleman left no relatives liv
ing who would be entitled legally to re
cover any damages obtained. The laws
of Washington govern because the train
wreck resulting in Farleman's death oc
curred In that state.
PROMOTIONS ABE EEADE.
Southern Pacific and O. R. & N.
Lines Effect Office Consolidation.
Another step was made in office con
solidation by the management of the
Southern Pacific and O. R. & N. a couple
of days ago, when J. W. Morrow, who for
the past year has been filling the position
of tax agent of the O. R. & N., was pro
moted to fill the newlT-creatod position
of tax and right of way agent for both
the O. R. & N. and the Southern Pacific.
Heretofore the two departments have
been distinct in each company. W. W,
Brethcrton lias had charge of the tax
and right of way department of the
Southern Pacific, while Mr. Morrow has
been the O. R. & N. tax agent, succeed
ing Ahlo S. Watt who held the position
for many years, until forced to relinquish
his place by falling eyesight.
Owing to the increased business and the
importance of the work in the two de
partments it has been found necessary to
readjust the service. On account of the
capability shown by Mr. Morrow In the
past year he was selected to fill the new
and enlarged position of tax and right of
way agent for the two companies.
W. W. Brethcrton. who has been tax,
claim and right of way agent for the
Southern Pacific, will continue to act in
the-capacity of claim agent for the com
pany. The changes will be made at
once, or as soon as the accounts and
books of the two offices can be made
ready for the transfer.
Holliday Not Known Here.
O. R. Holliday, who was arrested at
Jamosport, Mo., yesterday, and who, the
press dispatches stated, was wanted in
this city, is not known here. Holliday
was arrested for the alleged theft of Id
lers and money while a carrier on a rural
mall route about two years ago, but Post
master Mlnto knows nothing of the case.

REVISING THE CODE.
Oregon Military Officers Preparing to
Conform With Regular Army.
The committee of officers of the Ore
son National Guard appointed lor the
purpose of revising: the military code
of this state, met yesterday and -without
any action being; taken, adjourned
until December 8.
This committee is composed of Brigadier-General
W. E. Finzer, chairman;
Colonel C TJ. Gantenbeln, Colonel Gor
don Voorhies, Lieutenant-Colonel John
M. Poorman and Major John C. May, and
was appointed for the purpose of bring
ing: the Oregon code into uniformity
with the later National regulations.
While each state has the power to
formulate a code for Its own military
organization, yet since all state mili
tary organizations are subject to the
call of the Government, it has been
deemed advisable to make each state's
code uniform as near as possible to that
of the Government.
With this purpose in view the War
Department issued a circular asking
that a board of revision be appointed
in each state for the purpose of recom
mending to their respective. Legisla
tive bodies such changes as might be
necessary to make all military codes
conform to that of the War Depart
ment. As the Oregon code now stands, how
ever. It is so similar to the National
code that but little, if any, change will
be needed. After a careful considera
tion by the committee at Its next meet
ing, should any changes be deemed
necessary, they will be recommended to
the next Legislature.
To Improve City Jail.
The Police Department Is now pre
paring plans and estimates for the
completion of the third story of the
City Jail, and should sufficient funds be
on hand the Council will undoubtedly
order the Improvements.
Additional rooms for female prisoners
are badly needed, as at present there
Is but one room available for them.
This is the principal need at the City
Jail, and it is well provided for in the
contemplated improvements.
' Run Closes Wisconsin Bank.
WASHINGTON," Nov. 17. The Controller
